METROPOLITAN AREA PLANNING COMMISSION

MAY 12, 1998

 

MEMBERS PRESENT: Little, Damron, Finley, Beadles and Shaw

 

MEMBERS ABSENT: Coleman, Pitts and Phillips

 

The minutes of the April 14, 1998 meeting we approved as submitted.

 

#1 FP98-5 Kenny Findley requested final approval of subdivision plans for Forest Run Addition containing 7 lots on 5.25 acres.  The general location of the property is on the west side of Renee Drive, south of Jill Drive.

 

Property owners from Mardis Addition speaking in opposition to the subdivision were Glatney, Gathright, Hatley, Liebundgut, Moore and Doyle.  They were represented also by Attorney Glen Lovett.  A petition signed by many residents of Mardis Addition was presented to the Commissioners.  Drainage, traffic concerns, as well as adequate access already available to the Findley Subdivision, and violation of the bill of assurance for the Mardis Addition were points brought out by those who spoke in opposition.

 

Dr. Beadles moved to deny the final approval with the stipulation that Mr. Findley bring back a redesigned plan next month and work with the people opposing it and try to come up with a solution.  Ms. Shaw seconded, one voted aye, 3 no, MOTION FAILED. 

 

MOTION 1A

Ms. Shaw moved to approve, seconded by Mr. Damron.  Three voted aye, one no, MOTION FAILED. 

 

MOTION 1B

Ms. Shaw moved to amend the motion to approve by adding the stipulations of privacy fencing, drainage issues resolved whereby pipe extended does not end in neighbors front yard, Engineer's Comments and with the acknowledgment that the owner agreed to stipulations.  Mr. Damron seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#2 RP98-22 Kenny Findley requested approval of a replat of Lot 1A of the First Replat of Findley’s Pinehill Addition.  The general location of the property is on the north side of Pinehill Lane, west of Forest Hill Drive. 

 

TABLED by petitioner.  Easements for power lines to be shown on replat.  Get with appropriate utility to establish easement.

 

#3 RZ98-12 Roscoe Hays requested approval of rezoning from Residential R-1 to Residential R-2 for .49 acre located on the southeast corner of Harrisburg Road and Crowleys Ridge Road.

 

Mr. Clements and Mr. Ingels, property owners adjoining Mr. Hays' property, spoke in opposition to the rezoning.

 

Ms. Shaw moved to deny the request, citing spot zoning as reason for disapproval.  Mr. Damron seconded, five, including the Chair, voted aye, 0 no, REQUEST DISAPPOVED.

 

#4 RZ98-13 Sonny Sartin requested approval of rezoning from Residential R-3 to Commercial C-3 for Lot 39 and the north half of Lot 40 of the Northwest Addition.  The general location of the property is on the west side of N. Main Street, north of Gordon Street.

 

Ms. Shaw moved to recommend approval to the City Council, to bring existing use into compliance.  Mr. Damron seconded, 5 including the Chair, voted aye, 0 no, REQUEST APPROVED.

 

#5 RZ98-14 Jimmy and Mary Bradley, dba Jimmy Bradley’s Home Improvement, requested approval of rezoning from Residential R-1 to Commercial C-3 for Lots 1 and 2 of the replat of Robertson Subdivision.  The property is located at 5721 E. Nettleton Avenue.

 

Dr. Beadles moved to recommend approval to the City Council, to bring existing use into compliance, seconded by Mr. Damron.  Five, including Chair, voted aye, 0 no, REQUEST APPROVED.

 

#6 RZ98-15 Farmer Enterprises requested approval of rezoning from Residential R-1 to Commercial C-3 for 17.2 acres located on a part of the north half of the SW 1/4 of Section 14, T14N, R3E.  The general location of the property is north of Washington Avenue, south of Southern Pacific Railroad, and east of Matthews Avenue.

 

Ms. Shaw moved to recommend approval to the City Council, seconded by Mr. Damron.  Five, including Chair, voted aye, 0 no, REQUEST APPROVED.

 

#7 FPUD98-1 Alec Farmer requested final approval of plans for a Residential Planned Unit Development containing 14 units on 14 lots on 23.69 acres.  The general location of the property is on the north side of Nettleton Avenue, east of Strawfloor Drive.

 

Ms. Shaw moved to give final approval subject to building locations and landscaping being submitted to staff at time of building permit and if staff is not comfortable with it, it must come back to MAPC, and that there be no increase in spread of runoff now.  Ms. Finley seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#8 PUD98-2 Alec Farmer requested preliminary approval of plans for a Residential Planned Unit Development containing 72 units, on 72 lots on 23.86 acres.  The general location of the property is on the south side of Nettleton Avenue, east of Strawfloor Drive.

 

Dr. Beadles moved to approve the preliminary plan subject to:

1.  Permission from appropriate utility to locate retention ponds      in easement

2.  All Staff Comments

3.  Street improvements on West Nettleton

4.  Meeting PUD requirements for document submittal

Ms. Shaw seconded, four voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.       

 

#9 RZ98-16 Judson Nix requested approval of rezoning from Residential R-1 to Commercial C-5 for Lot 10 of Marlo Acres First Addition.  The general location of the property is on the east side of Southwest Drive, west of S. Culberhouse Street. 

 

Ms. Shaw moved to recommend approval to the City Council subject to a site plan being approved by MAPC before development.  Dr. Beadles seconded, five, including Chair, voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#10 RP98-21 Ridgepointe Development Corp. Requested approval of a replat of Lot 21, Block V of #5 Fairway Homes, all in Ridgepointe Country Club Phase VI.  The general location of the property is on the north side of Pebble Beach Drive, east of Masters Drive.

 

Ms. Finley moved to approve the replat, seconded by Dr. Beadles.  Four voted aye, 0 no, REQUEST APPROVED.
