AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS,: ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R1); DECLARING AN EMERGENCY: AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on October 15, 1980; and
WHEREAS, said petition for annexation was duly executed by the owners of all the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon this Petition was held in the County Court of Craighead County, Arkansas on December 16, 1980, at which hearing it was duly found and declared that said petition for annexation was right and proper and that these lands hereinafter should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of annexation was made and entered; and
WHERAS, thirty (30) days have expired since the Order of annexation dated December 16, 1980 and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas; and
WHEREAS, the Metropolitan Area Planning Commission has made its recommendation to City Counsel of the City of Jonesboro that this property be annexed into the city with the zoning classification (R-1).
NOW, THREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territories and lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas by its Order of December 16, 1980, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:
Begin Survey at the Quarter Section Corner of Section 5 and 4, Township 13 North, Range 4 East. Thence South along the Section Line 4.5 feet to a point; thence South 88° 38’ West 30.0 feet to the point of beginning proper. Thence South parallel to the Section line 590.1 feet to a point; thence South 88°30’ West 1169.0 feet to a point; thence South 0°11’ East 368.4 feet; thence South 88°26’ West 615.2 feet to a point; thence North 0° 09’ 210.0 feet to a point; thence South 88°03’ West 440.0 feet to a point on the East right-of-way of Arkansas State Highway No.1: thence Northerly along the East right-of-way of said Arkansas State Highway No.1, 1295.7 feet to the Northwest Corner of property being surveyed; thence North 88°32’ East 1104.2 feet to a appoint; thence South 0°12’ East 533.6 feet to a point, thence North 88°38’ East 1169.7 feet to a point of beginning proper, containing 51.657 acres, more or less.
Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to Ward 5 to the City of Jonesboro, Arkansas.
Section 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Residential (R-1).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of this territory can be entitled to fire, police, zoning, water and sewage and other protection and benefits; that these benefits and protection are urgently needed in order to allow orderly growth and development of said lands and territories. Therefore, an emergency is hereby declared to exist as this ordinance is necessary for the preservation of public peace, health, safety and welfare and shall take effect and be in full force from and after its passage and approval.
