The minutes of the February 14, 2002 meeting were approved as prepared.

#1  CU02-6 Muegge, Inc. requested approval of a conditional use to construct a mini-warehouse facility in the C-3 General Commercial District.  The address of the property is 2213 W. Parker Road, and the general location of the property is on the southwest side of Parker Road, south of Strawfloor Drive.

Dr. Beadles excused himself from the meeting and Mr. Damron was acting chairman for this item.

David Conrad, representing Muegge, Inc. stated they wanted to build a 2,500 square foot office on the front side of the property and a 6,000 square foot mini-warehouse on the back side of the property.

Jack Moffitt, representing an adjacent property owner, stated opposition to the warehouse proposal stating that it would not be in keeping with the type of development the NEA Clinic has constructed next door.    Mr. Moffitt further asked that this matter be tabled until such time as elevation drawings and complete landscaping plans have been prepared and reviewed.

Glenn Batten, City Planner, explained that an existing billboard on site would remain with the new development.  The site is highly visible from Highway 63.  The proposed office is a permitted use by ordinance but the warehouse addition in the back requires approval by the MAPC as a conditional use.  A revised site plan with landscaping was submitted on March 7 or 8, well past the deadline for submission, but has not been reviewed in detail yet.

Mr. Batten suggested that the site be heavily landscaped with blended architecture as much as the developer is willing to do and recommended that the conditional use be granted with the stipulation that the site be heavily landscaped and screened and made as compatible with the surrounding uses as possible.

Claude Martin, City Engineer, stated that he hasn’t seen the detailed site plan and would reserve his comments until he has reviewed the plans.

When asked about an overlay, Mr. Batten explained that a limited use overlay would not apply here like it might in other cases.  The zoning is already C-3 and the warehouse use would be the only use permitted under the conditional use permit and there are no architectural controls permitted.

Mr. Krennerich stated that if the MAPC is to be convinced that this use should be approved as a conditional use that they would need to submit elevation drawings of the building and see where landscaping and buffering is proposed to be and see if the use would be compatible with surrounding development.

Phillip Crego, City Attorney, stated that are several criteria set out in Section 14.24.02 of the Zoning Ordinance including, but not limited to, the proposed use being designated, located and proposed to be operated that the public health, safety and welfare are protected, and that the propose use is compatible with and will not adversely affect other property in the area.  Phillip also stated that landscaping and screening provisions are included.

Mr. Krennerich made a motion to table the request subject to lack of information regarding landscaping and other pertinent information.  The motion was seconded by Mr. Johnson.  Voting was 5 in favor, 0 opposed.  Those voting aye were Little, Street, Krennerich, Johnson, Farmer, MOTION CARRIED, REQUEST TABLED.

#2  CU02-7 James Burton, Jr. requested approval of a conditional use for placement of a Manufactured Home, Residential Style, in the Residential R-1 Single-Family Medium Density District.  The address of the property is 1405 Magnolia Road.

Mr. Burton explained that the existing home on site is condemned and is to be removed or demolished to make way for this manufactured home.

Mr. Damron made a motion to approve the request with the following stipulations:

1.  Remove existing home prior to placement of new home

2.  Inspection of the foundation prior to placement

3.  Inspect  the manufactured home for compliance with the residential design  standards

Todd Rice, representing the Vanadis Group, stated their proposal is to construct a multi-family development consisting of 80 units, with 15 one bedroom units and 65 two bedroom units.  The development will be known as Church Street Place.  The apartments range in size from 690 to 1150 square feet.   Mr. Rice stated that the second phase proposed 40 additional units.  There will be parking below with three stories above the parking.  This request covers both phases.

Glenn Batten, City Planner pointed out that site development plans would be forthcoming for approval by the MAPC if the conditional use is approved.  This proposal is part of the downtown revitalization contained in the Land Use Plan.

Mr. Krennerich made a motion to approve the conditional use request for Phases I & II with the stipulation that complete site plans be submitted to the MAPC for review and approval by the MAPC.  The motion was seconded by Mr. Street.  Voting was 6 in favor, 0 opposed.  Those voting aye were Street, Farmer, Krennerich, Little, Damron, Johnson, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

#8  FP02-4 Jim Abel requested final approval of subdivision plans for Kensington Estates Phase II.  The subdivision contains 23 lots on 6.30 acres and is located on the east side of Culberhouse Street and is a continuation of Charleston Drive.

Dr. Beadles pointed out that when Gladiolus Drive was dedicated and built several years ago, it was dedicated with a right of way of 88' which is much more than normally required  by the City and the reason for doing so was to try to get a street connection between Gladiolus Drive and Culberhouse Street and ultimately to Highway 49.  With the mall being developed on the south side in the vicinity of Kellers Chapel Road, which is one option for additional access across the south side of town, the subject of this cross connection came up again.  The Mayor met with Jim Abel and discussed the dedication of the street right of way for the thoroughfare.  Mr. Abel said he needed to discuss this with his family and later came back and said he wasn’t going to do it and they were not interested in doing that.  The Mayor then backed off from the proposal stating he would not push it since the developer was against it.  At the February MAPC meeting preliminary approval was granted on all three proposed phases of his subdivision.  In giving preliminary approval there were nine or ten stipulations attached to that approval.  If the developer addresses and satisfies those stipulations, they are entitled to bring the plans back for final approval.

Mr. Abel stated for the record that he objected to the proposed street from the very beginning including the first conversation with the Mayor.

Glenn Batten, City Planner, questioned Mr. Abel about the undeveloped property east of these subdivisions between Higginbottom Creek and the Mardis Addition.  Mr. Abel responded that he owned approximately 50 acres across Higginbottom Creek.  He plans to bridge across the creek and develop that land and provide a street that will connect to Mardis Drive in the Mardis Addition.  There will be a residential street that makes its way through from Harrisburg Road to Culberhouse Street.

It was noted that all the stipulations attached to the preliminary approval had been addressed.  The stipulations were engineering in nature and Claude Martin, City Engineer, stated that he and Carlos Wood, Project Engineer, had gone over the plans and the stipulations have been met.

Mr. Johnson made a motion to grant final approval for item #’s 8, 9 & 10 The motion was seconded by Mr. Farmer.  Voting was 6 in favor, 0 opposed.  Those voting aye were Johnson, Krennerich, Farmer, Street, Damron, Little, MOTION CARRIED, REQUEST APPROVED.
