AN ORDINANCE TO AMEND ORDINANCE NO. 776 THE SAME BEING AN ORDINANCE PROVIDING FOR THE LICENSING OF ELECTRICIANS, CONTRACTORS, ETC., UNDER THE ELECTRICAL CODE FOR THE CITY OF JONESBORO, ARKANSAS (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-77:2126 ON JULY 18, 1977)

BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
 
Section 1: Section 6 of Ordinance No. 776 is amended as follows: Licensed Electricians to Report Names, etc., of electricians and apprentices employed by them.
 
All licensed electricians shall report to the board the name, address, the telephone number of all licensed electricians and registered apprentices employed by them. Any licensed electrician failing to comply with this provision may be suspended. The reporting of the above information is to be done before January 31 of each year and within 30 days of the employment of any new electrician or apprentice.
 
Section 2: Section 8 of Ordinance No. 776 is amended as follows:
 
Bond Requirement: All persons doing business in the City of Jonesboro as a licensed electrical contracting business shall keep filed with the City Clerk a bond in the penal sum of $5,000.00 with an incorporate insurance company authorized to do business in the city as surety, which bond and surety shall be approved by the City Clerk.
 
The condition of such bond shall be that the principle and surety shall indemnify the city for its own use, and/or to any citizen against loss by improper electrical work; that the principle shall strictly comply with the ordinances of the city governing such work; that the principle shall do or suffer no work to be done without a permit and will report work done for inspection by the electrical inspector in conformity with the laws of the city. Said bond shall be renewed annually, not later than January 31st.
 
Any licensed electrician not licensed within the City of Jonesboro, will be required to post a bond, as required above, while working on any electrical construction job in the city.
      
Licensed electrical contractors not licensed in the City of Jonesboro will be required to take the appropriate examination or pay $100.00 per construction job for which the necessary permits have been obtained.
 
Section 3: Section 10 of Ordinance No. 776 is amended as follows: Revocation of certificate of competency.
 
The board may revoke or cancel any certificate of competency issued for any violation or noncompliance with any of the ordinances of Jonesboro or the rules and regulations of the board or on account of in-competency of the person holding the certificate. The certificate of competency may be revoked if the person does not pay his license fee during the current calendar year. If  his license fee has not been paid he will be required to either take a new examination or pay all delinquent fees, including the current year, upon approval of the board.
 
Section 4: Section 12 of Ordinance No. 776 is amended as follows:
 
Penalty for Violations:
 
Any person who shall violate or fail to comply with any of the provisions of this article or the rules and regulations of the board shall be deemed to be guilty of a misdemeanor.
 
Section 5: Section 2 of Ordinance No. 776 is amended as follows:
 
      Same Organization: Records to be kept. Quorum:
      
The board shall elect a chairman and a secretary. The latter shall keep a full and complete record of the proceedings of the board, including the names, addresses of persons engaged in the electrical business in Jonesboro, keeping a list of master electricians, journeymen electricians, electrical maintenance men, and registered apprentices working in Jonesboro. A majority of the board shall constitute a quorum.
 
Section 6: Section 4 of Ordinance No. 776 is amended as follows:
 
Certificate of Competency Required; Applications and Examinations; License Card Issued by City:
 
Shall before engaging in such business, procure a certificate of competency from the board. Applications for such certificates shall be made to the City Electrical Inspector in writing who shall transmit same to the secretary of the board. Applicants shall deposit with the City Collector the following required examining fees.
 
A.      Master Electrician -- $100.00.
B.      Journeyman Electrician and Electrical Maintenance men --$10.00.
 
The fee will include the license fee for the remainder of the year that the examination was passed. The renewal license fee for the journeyman electrician and electrical maintenance man will be $5.00 per years, and the master electrician will be $10.00 per year. There is no fee for the apprentice.
 
Whenever an applicant for a certificate of competency shall have failed an examination given him on his application for a certificate of competency, he shall be required to wait until the next regularly scheduled examination time to be examined. The examination fee will allow an individual to take two examinations to obtain a certificate of competency.
 
The City's electrical inspection office will provide the necessary forms for registering all master, journeymen, maintenance men and apprentice electricians. The electrical inspection office will issue a card to each master journeyman and maintenance man electrician upon payment of the license fees. The cards must be carried by the electrician while working on construction job and must be shown to the electrical inspector at his request. Any person not holding a current license card in performing electrical work will be required to halt their work until they show evidence that they are currently licensed to perform the work they are doing.
 
Section 7: All ordinances and/or part of ordinances in conflict herewith are hereby repealed.
 
Section 8: It is found and declared by the City Council that this ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall take effect from and after its passage and approval.
