AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MARCH 18, 1968:  ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, on February 14, 1968, and

 

WHEREAS, said petition for the annexation of said land was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court on March 18, 1968, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty days have expired since the order of annexation date March 18, 1968, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court by its order of April 18, 1968.

 

NOW THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

 

Section 1:  The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order of March 18, 1968, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2:  The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:

 

Beginning at the Northeast Corner of the Northeast Quarter of the Southeast Quarter of Section 23, Township 14 North, Range 3 East; thence South 89 degrees 40 minutes West 590.0 feet along the North line of the Northeast Quarter of the Southeast Quarter; thence South 28 degrees 24 minutes West 535.5 feet; thence South 22 degrees 28 minutes West 129.20 feet; thence South 21 degrees 22 minutes West 144.84 feet; thence South 68 degrees 38 minutes East 140.0 feet; thence North 89 degrees 40 minutes East 801.59 feet; thence North 1 degree 6 minutes East 775.22 feet along the East line of Section 23 to the point of beginning proper, containing 13.86 acres more or less.

 

Section 4:  It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the city’s next census count; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that same be annexed to the City so that the said territory that is set out above can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory.  Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage.
