AN ORDINANCE TO VACATE A TWENTY FOOT ALLEY BETWEEN CHERRY AVENUE AND ELM AVENUE.

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
WHEREAS, a Petition was duly filed with the City Council for the City of Jonesboro, Arkansas on the 28th day of October, 1988, to vacate and abandon a 20 foot alley running North and South between Cherry Avenue and Elm Avenue in the 600 Block West of Main Street between Lots 1 and 8 of Block 27 of Culberhouse Subdivision of Lots 27, 29, 43, 44, 46, 47, 52 of Knight's Second Addition to Jonesboro - Plat recorded in Deed Record 20 at page 506 of the Records of the Jonesboro District of Craighead County, Arkansas. (A. C. Williams, Jr. 667 Elm), and
The West part of Lot on Block 28 of Knight's Second Addition Jonesboro - Plat recorded in Deed Record 9 at page 375 of the Records of the Jonesboro District of Craighead County, Arkansas.
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street or the portion thereof, hereinbefore described as heretofore been dedicated to the public use as a street herein described; has not been actually used by the public generally for a period of the last five (5) years subsequent to the filing of the plat; that all owners of the property abutting upon the portion of the street to be vacated have filed with the Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such street.
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to the streets designated as follows:
The alley running North and South in the 600 Block West of Main Street between Cherry and Elm Avenue and separating the Culberhouse Subdivision of Block 27, Knight's Second Addition to the Town of Jonesboro, Craighead County, Arkansas and block 28 of Knight's Second Addition to the Town of Jonesboro, Craighead County, Arkansas.
SECTION 2: A copy of the ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the deed records of the County
SECTION 3: This ordinance shall take effect and be in force from and after its passage and approval.
