AN ORDINANCE ANNEXING CERTAIN LANDS THAT ARE COMPLETELY SURROUNDED BY THE INCORPORATED LIMITS OF THE CITY OF JONESBORO; ASSIGNING SAID ANNEXED TERRITORIES TO WARD 4; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS Act 314 of 1979 provides that unincorporated islands of land that have been completely surrounded by the incorporated limits of a municipality may be annexed by the municipality; and
WHEREAS the City of Jonesboro has found that its incorporated limits have completely surrounded an unincorporated area hereinafter described; and
WHEREAS the areas to be annexed comply with the standards for lands qualifying for annexation which are set forth in Ark. Stat. 19-307.1 and Act 314 of 1979; and
WHEREAS a public hearing was held August 6, 1990, regarding this proposed annexation; and
WHEREAS on July 6 and July 13, 1990, a legal notice was published setting out the legal description of the territory proposed to be annexed and all property owners within the area were notified by certified mail of their right to appear at the public hearing.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That the following described unincorporated areas which are completely surrounded by the City Limits of the City of Jonesboro are hereby annexed to the City of Jonesboro and said territory shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:
Beginning at the northeast corner of Section 28, T14N, R3E; thence south along the east line of the north half of the NE 1/4, NE 1/4 of Section 28, T14N, R3E to the southeast corner thereof, the point of beginning proper: thence continue south along the east line of said Section 28 to the southeast corner of the SE 1/4, SE 1/4 of Section 28, T14N, R3E; thence west along the south section line of the southwest corner of the SE 1/4, SE 1/4 of Section 28, T14N, R3E; thence north along the quarter section line of said SE 1/4, SE 1/4 to the southwest corner of the north half of the NE 1/4, NE 1/4 thence east along the South line of the north of NE 1/4, NE 1/4 of Section 28, T14N, R3E, containing 140 acres, more or less, and
Beginning at the southeast corner of the SE 1/4, SW 1/4 of Section 28, T14N, R3E; thence north along the half section line of said SW 1/4 to the Southeast corner of the north half of the NE 1/4, SW 1/4 of Section 28, T14N, R3E; thence west along the south line of the north half of the said NE 1/4, SW 1/4; thence south along the quarter section line of the said NE 1/4, SW 1/4 to the south section line of Section 28, T14N, R3E: thence east along said section line 395.0', more of less, to a point on the north section line of Section 33, T14N, R3E; thence south to the northerly right-of-way of Arkansas Highway 226; thence southeast along the meanderings. of said right-of-way of Highway 226 a distance of 735.0', more or less, to a point; thence east 302.6' to a point; thence south 342.0', more or less, to a point on the northerly right-of-way of Arkansas Highway 226; thence southeasterly some 95.0' , more or less, along said right of way to a point on the east line of the NE 1/4, NW 1/4 of Section 33, T14N, R3E; thence north along the half section line of said NE 1/4, NW 1/4 to the southeast corner of the SE 1/4, SW 1/4, of Section 28 T14N, R3E, containing 70 acres, more or less, AND Beginning at the northeast corner of the NE 1/4, SW 1/4 of Section 33, T14N, R3E: thence west along the north line of the said NE 1/4, SW 1/4, of Section 33, T14N, R3E, to the northwest corner thereof; thence south along the west line of said NE 1/4, SW 1/4, to the southeast corner of the north half of the NW 1/4, SW 1/4 of Section 33, T14N. R3E; thence west along the line of said north half of the NW 1/4, SW 1/4 to a point; thence south to a point on the south line of the NW 1/4, SW 1/4 of Section 33, T14N, R3E; thence east along said south line to the southeast corner of the NW 1/4, SW 1/4 of Section 33, T14N, R3E; thence north some 300.0', more or less, to a point; thence east to the east line of the NE 1/4 SW 1/4 of Section 33, T14N; thence north to the northeast corner of the NE 1/4, SW 1/4, containing 43.83 acres, more or less.
SECTION 3: Said lands and territory annexed to the City of Jonesboro, are hereby classified for purposes of zoning as Residential - 1 (R-1).
SECTION 4: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to Ward 4.
SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is not an extreme urgency that the territory herein be immediately annexed to an accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands an territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
