AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, CRAIGHEAD COUNTY, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED JANUARY 2, 1975, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed with the County Clerk of Craighead County, Arkansas, Western District, on January 2, 1975; and

 

WHEREAS, said petition for the annexation of said lands was signed by a majority of the real estate owners owning a majority of the acreage annexed to the City of Jonesboro; and

 

WHEREAS, an order setting a hearing on said petition was entered, and notice was duly published of said hearing, and hearing upon said petition was duly had and held in the County Court of the 4th day of February, 1975, at 9:30 A.M., at which hearing it was duly found and declaring by the court that said petition for annexation was right and proper, and that said lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made an entered; and

 

WHEREAS, thirty (30) days have expired since the order of annexation dated February 4, 1975, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated February 4, 1975, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants within the new annexation shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City, Arkansas.

 

Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

The Northeast Quarter of the Northeast Quarter of Section 35, Township 14 North, Range 3 East; the Northwest Quarter of the Northwest Quarter and the North 17 acres of the Southwest Quarter of the Northwest Quarter, all in Section 36, Township 14 North, Range 3 East (Including Lot 1 in Block A, Lots 1, 2 and 3 in Block B, Lots 1, 2, 2, 4, 5 and 6 in Block D, and Lot 1, Block E, of Candlewood Estates First Addition, Jonesboro, Craighead County, Arkansas, as shown by plat in deed record 198 page 20, subject to bill of assurance in deed record 216 page 100, and to easements as shown on recorded plat). All property is located in the Jonesboro District of Craighead County, Arkansas.

 

Section 3: The lands and territory annexed to the City of Jonesboro are hereby accepted by the City and assigned and attached to Ward 4.

 

Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory, and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage. 

 

PASSED and ADOPTED this 19th day of May, 1975.
