METROPOLITAN AREA PLANNING COMMISSION

APRIL 10, 2001

 

MEMBERS PRESENT: Beadles, Damron, Gott, Johnson, Phillips

MEMBERS ABSENT: Little, Bennett, Krennerich, Shaw

 

The minutes of the March 13th and March 30th, 2001 meetings were approve as prepared.

 

#1 RZ01-12 Robert Layne requested rezoning, from R-1 Residential to C-3 Commercial, of 0.80 acres located at 2217 Woodsprings Road.

 

WITHDRAWN PRIOR TO MEETING TIME.

 

#2 RZ01-13 Mitchell Caldwell requested approval of rezoning from Residential R-1 and Residential R-2 to Residential R-3 for 50.49 acres located on a part of the NW 1/4 of Section 3, T13N, R4E.  The general location of the property is on the east side of Richardson Road, north of Keely Drive.

 

WITHDRAWN BY MR. CALDWELL AT MEETING.

 

#3 RZ01-14 Jimmy Doyle Hunt requested approval of rezoning for Lot 1 of G & S First Subdivision and Lot 1 of Jimmy Doyly Hunt Replat of James & Linda Cole’s Replat of Lot 1 & 2 of G & S First Subdivision and a part of Lot 5 , Block H of Highland Park Addition, containing 1.45 acres in all.  The general location of the property is on the southwest corner of Church Street (Hwy 141) and Ginger Drive.

 

Mr. Phillips made a motion to recommend approval of the rezoning to the City Council with Mr. Johnson making the second.  Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.

 

#4 RZ01-15 Curtis Tate, Albert Tate, Marie Sinks, Lonnie Clark, Darrell Broadway, Leslie Langley, Wanda Cooper, Jackie Looney and the Jehovah’s Witness requested approval of rezoning for part of Broadway’s Addition from Residential R-2 To Commercial C-3.  The properties are located at 713 & 715 S. Patrick Street, and 859 & 903 Logan Avenue, 900, 904 & 906  E. Matthews Avenue.

 

It was pointed out that properties to the west, south and east had all been rezoned in recent years for professional office usage.  The petitioners stated that this is what they wanted for their property as well.

 

A motion was made by Mr. Damron to recommend approval of a Commercial C-5 zoning rather than Commercial C-3 to the City Council.  The motion was seconded by Mr. Gott.  Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED FOR C-5 ZONING.

 

#5 SU01-3 Sach Oliver requested permission to locate a mobile home/manufactured home at 2416 West Matthews Avenue.

 

It was clarified that this placement is north of the barn located at 2416 W. Matthews Avenue.  A motion to approve the request was made by Mr. Damron and seconded by Mr. Phillips.  Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED.

 

#6 FP01-05 Mike Layman requested final plat approval for the subdivision of approximately 99 acres, to be known as Layman Crest Estates, generally located east of Mt. Carmel Road and south of Kellers Chapel Road, into 55 residential lots.

 

There was considerable discussion regarding access to adjacent properties from this subdivision.  A second outlet to Mt. Carmel Road was added to the final plans as well as an additional outlet toward the northeast side of the development.  The outlet to the south was opposed by the property owner to the south and is not being required at this time.  Drainage easements had been added to the plat but had not been seen or approved by the City Engineer. 

 

Mr. Phillips made a motion to approve the request subject to approval by the City Engineer on the drainage easements that were added to the final plans and specifically not require an access to the south.  The motion was seconded by Mr. Gott.  Voting was 4 in favor, 1 opposed, MOTION FAILED.

 

#6A  A second motion was made by Mr. Damron to approve the request subject to:

 

1.  A second outlet being added toward the southeast side of the property providing access to lands to the east

2.  Revised plans shall include plan, profile, drainage and improvement plans

3.  Approval by the City Engineer on the drainage easements

4.  Approval of revised final plans by city staff

 

The motion was seconded by Mr. Phillips.  Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#7 PP01-02 Mitchell Caldwell requested preliminary plat approval for the subdivision of 9.90 acres into 39 residential lots, to be known as Caldwell Acres IV Addition, generally located east of Richardson Road, north of Keely Drive.

 

WITHDRAWN ALONG WITH REZONING REQUEST.

 

#8 PP01-03 Mitchell Caldwell requested preliminary plat approval for the subdivision of the Replat of Lot 7 of a Replat of Lot 5 (Revised) Sixth Addition into 22 residential lots, generally located west of Richardson road, south of Jeridon Cove.

 

Mr. Phillips made a motion to grant preliminary approval of the subdivision subject to:

 

1. Providing base flood elevations for the flood plain on the final plans

2.  Engineering analysis of the pipe under Richardson Road to determine its adequacy

3.  Providing an overall plan of all of the phases together on the final submittal

 

The motion was seconded by Mr. Gott.  Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#9 FP99-14  Reconsideration of conditional approval of Woodsprings Estates V Addition (due to the apparent inability to resolve drainage considerations).  The general location of this property is on the north side of Woodsprings Road, east of Casey Springs Road.

 

WITHDRAWN PRIOR TO MEETING.  WILL BE PLACED ON 5-8-01 AGENDA.

 

#10 PP01-04 James Darnell requested preliminary approval for the subdivision of 11 acres into 45 residential lots, to be known as Woodridge Subdivision Second Addition, generally located north of Greensboro Road and west of Scott Street (Sandino Dr. extended north).

 

Mr. Johnson made a motion to grant preliminary approval of the subdivision plans subject to providing an outlet to connect to Mays Road.  The motion was seconded by Mr. Phillips.  Voting was 5 in favor, 0 opposed, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.
