CITY COUNCIL MINUTES SEPTEMBER 6, 1977

 

The Jonesboro City Council met in regular session, Tuesday, September 6, 1977, at 7:30 p.m. There were present: Mayor, City Clerk, City Attorney and the following named aldermen: Park, Sanderson, Hinson, Shelton, Bridger, Minx, Hannah, Haigler, Stricklin, Smith, Province and Shepard.

 

The meeting began with Pledge of Allegiance and Prayer.

 

Mr. Stricklin moved that the minutes of the August 15, meeting be approved as mailed, seconded by Mr. Bridger and receiving unanimous vote of council.

 

Mr. Hannah offered the following ordinance:

                     

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED MARCH 23, 1977; ASSIGNING SAID ANNEXED TERRITORY TO WARD ____; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Stricklin offered the following ordinance:

 

AN ORDINANCE AUTHORIZING A LEASE AND AGREEMENT BY AND BETWEEN THE CITY OF JONESBORO, ARKANSAS, AS LESSOR AND DELTA, INC., OF ARKANSAS, AS LESSEE, IN SUBSTANTIALLY THE FORM AND WITH THE CONTENTS SET FORTH AND MADE A PART OF THE ORDINANCE: AUTHORIZING THE EXECUTION AND DELIVERY OF THE LEASE AND AGREEMENT; PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY

 

Mr. Stricklin moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Sanderson, all voted aye. Mr. Sanderson then moved that the rules be further suspended and the ordinance be placed on 3rd reading, seconded by Mr. Stricklin, all voting aye except Mr. Province. After the third reading, Mr. Sanderson moved for the adoption of the ordinance, seconded by Mr. Hinson, all voted aye and the ordinance was given #1603.

 

Mr. Shelton offered the following ordinance:

 

AN ORDINANCE AUTHORIZING THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS UNDER ACT NO. 9 OF THE FIRST EXTRAORDINARY SESSION OF THE SIXTY SECOND GENERAL ASSEMBLY OF THE STATE OF ARKANSAS, APPROVED, JANUARY 21, 1960, AS AMENDED, FOR THE PURPOSE OF PROVIDING PERMANENT FINANCING OF THE COSTS OF SECURING AND DEVELOPING INDUSTRY (THE PARTICULAR INDUSTRIAL PROJECT IS DESCRIBED IN THE ORDINANCE); AUTHORIZING THE EXECUTION AND DELIVERY OF A TRUST INDENTURE SECURING THE BONDS; AUTHORIZING AND PRESCRIBING OTHER MATTERS PERTAINING TO THE ACQUISITION AND CONSTRUCTION THEREOF: AND DECLARING AN EMERGENCY

 

Mr. Stricklin moved that the rules be suspended and the ordinance placed on 2nd reading, seconded by Mr. Sanderson, All voted aye. Mr. Minx then moved that the rules be further suspended and the ordinance be placed on 3rd reading, seconded by Mr. Shelton, all voted aye. Mr. Sanderson moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Stricklin. All voted aye and the ordinance was given #1604.

 

Mr. Sanderson offered the following resolution:

 

RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE A FIRST SUPPLEMENTAL LEASE AND AGREEMENT AMENDING THE LEASE WITH DELTA, INC.

 

The resolution was given the number 1977:12.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE VACATING AND ABANDONING TWO ALLEYS LOCATED BETWEEN BLOCKS E, D, G AND H OF SIGLER’S COLLEGE ADDITION TO THE CITY OF JONESBORO, ARKANSAS: AND FOR OTHER PURPOSES

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES; AND FOR OTHER PURPOSES

 

Mr. Stricklin moved for the adoption of the Ordinance to include the emergency clause, seconded by Mr. Park. Voting aye: Park, Sanderson, Hinson, Shelton, Bridger, Hannah, Haigler, Stricklin, Smith and Shepard. Voting nay, Minx and Province. The ordinance was adopted and given #1596.

 

Mr. Hinson offered the following ordinance:

 

AN ORDINANCE PROVIDING FOR CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF: AND FOR OTHER PURPOSES

 

Mr. Hinson offered the following ordinance:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD____: ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3): DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Stricklin moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Shelton. Voting aye: Park, Sanderson, Hinson, Shelton, Bridger, Minx, Stricklin, Smith and Shepard. Voting nay: Hannah, Haigler and Province. Motion carried.

 

Mr. Province offered the following ordinance:

 

AN ORDINANCE AMENDING ORDINANCE NOS. 1474, 1475 AND 1476; ORDINANCE DESIGNATING CERTAIN STREETS AS ONE-WAY STREETS DURING SCHOOL MONTHS; AND FOR OTHER PURPOSES

 

Mr. Stricklin moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Park, all voted aye. Mr. Park then moved that the rules be further suspended and the ordinance be placed on 3rd reading, seconded by Mr. Sanders, all voted aye. Mr. Park then moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Stricklin, all voted aye, the ordinance was given #1607.

 

Mr. Park offered the following ordinance:

 

AN ORDINANCE PROVIDING FOR CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF: AND FOR OTHER PURPOSES

 

Mr. Park moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Hinson, all voted aye. Mr. Hinson then moved for the third reading of same, seconded by Mr. Park, all voted aye. Mr. Park then moved for the adoption of the ordinance, seconded by Mr. Stricklin, all voted aye. The ordinance was given the number 1608.

 

Mayor announced that the appeal from MAPC would be heard September 12 at 7:30 p.m.

 

Mr. Hannah offered the following ordinance:

 

AN ORDINANCE TO AMEND ORDINANCE #954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES

 

Mrs. Clarence Freeze, representing Jonesboro Council of Garden Clubs, advised council that they have set the week of October 3-14 as “Clean Sweep Jonesboro” and Mr. Sanderson moved for the approval of same, seconded by Mr. Park, all voted aye.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE WHEREBY THE CITY OF JONESBORO, VACATES, ABANDONS ALL ITS RIGHTS, TOGETHER WITH THE PUBLIC USE OF STREET KNOWN AS DANNY DRIVE

 

Mr. Sanderson moved for the adoption of the ordinance, seconded by Mr. Park, all present voted aye. Mr. Hinson was not present for roll call. The ordinance was adopted and given the #1586.

 

Kenneth Camp, Chairman of Parks Commission, recommended to council that Dale Roberson be employed as planner for Craighead Park at a cost of $14,500.00. Mr. Hannah moved that the request be granted, seconded by Mr. Minx. Mr. Hinson was not present for toll call. Mr. Sanderson voted nay and the remaining aldermen cast a yea vote.

 

Mr. Hannah complimented the Commission on the caliber of planners presented council for consideration.

 

The Mayor appointed the following committee to meet with Jonesboro Urban Renewal at their meetings: Sanderson, Haigler and Shepard.

 

The cemetery committee was asked to look into the feasibility of annexing the Pine Log Cemetery into the city.

 

Mr. Sanderson offered the following resolution:

 

RESOLUTION AUTHORIZING THE CITY OF JONESBORO, ARKANSAS TO FILE FOR A GRANT ON ADMINISTRATION ON AGING, DEPARTMENT OF HEALTH, EDUCATION, AND WELFARE

 

Mr. Hannah moved for the adoption of the resolution, seconded by Mr. Shelton, all present voting aye. Mr. Hinson was not present for roll call. The resolution was given the number 1977:13.

 

Mr. Hannah moved that the condemnation proceedings at 1000 and 1002 Cartwright be delayed for two weeks, seconded by Mr. Stricklin. Voting aye: Sanderson, Bridger, Minx, Hannah, Stricklin, Province and Smith. Voting nay: Park, Shelton, Haigler, Shepard; motion passed.

 

Mr. Sanderson moved that the City be given permission to accept bids on five police units, seconded by Mr. Hannah, all present voted aye.

 

The following bids were opened on chassis:

 

O’Neal Fore                      $18,981.00

Town & Country                     18,294.00

 

Mr. Stricklin moved that the bids be referred to the Finance Director and Fire and Police Committee, seconded by Mr. Park, all voted aye.

 

The following bids were opened for a pumper:

 

Safety Products                      $101,500.00

Boardman Co.                     90,750.00

 

These bids were also referred to the committee.

 

The following bids were opened for a dump truck:

 

O’Neal Ford                      26,798.00

Town & Country                     26,818.00

 

Mr. Bridger moved that the low bid from O’Neal Ford be accepted, seconded by Ms. Haigler. Voting aye: Park, Shelton, Bridger, Minx, Hannah, Haigler, Stricklin and Province; Voting nay: Sanderson, Smith and Shepard.

 

There being no further business, council adjourned.
