AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED JUNE 30, 1976, ASSIGNING SAID ANNEXED TERRITORY TO WARD 2, DESIGNATING AND ZONING SUCH TERRITORY AS R-1, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, herein after described, was duly filed in the County Court of Craighead County, Arkansas on May 28, 1976; and
WHEREAS, said petition for the annexation of said land was signed by all of the owners of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, a date for hearing upon said petition was set, notice was duly published of said hearing, and the hearing upon said petition was duly had and held in the County Court on June 30, 1976 at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands herein described should by annexed to the City of Jonesboro, Arkansas whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the order of annexation dated June 30, 1976, and no proceedings to prevent said annexation have been failed or instituted in the Circuit Court for the Jonesboro District of Craighead County, Arkansas and said annexation proceedings were in all things confirmed by the City Court by its order of August 2, 1976,
NOW THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas by order of the County Court of Craighead County, Arkansas by its order of June 30, 1976, be and are hereby accepted by the City of Jonesboro, Arkansas and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas and the residents residing herein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:
Part of the Northeast Quarter of the Northeast Quarter of Section 23, Township 14 North, Range 3 East, Craighead County, Arkansas and being more particularly described as follows: Commencing at the Northeast Corner of Section 23, aforesaid; thence South 1° 49’ West 281.14 feet to point of beginning proper; thence South 1° 49’ West 623.7 feet; thence North 89°57’ West 500.2 feet; thence North 7° 33’ West 223.8 feet; thence Northeasterly along the arc of a 31.735 degree curve to the left 60.2 feet; thence North 0° 22’ East 135.9 feet; thence North 89°38’ West 23.4 feet; thence North 0°22’ East 150 feet; thence South 89°38’ East 7.0 feet; thence North 0°22’ East 210 feet; thence South 89° 43’ East 298.2 feet; thence South 0° 45’ West 110.8 feet; thence East 208.6 feet to the point of beginning proper; and containing 8.88 acres more or less.
Section 3: The lands and territory annexed to the City of Jonesboro, Arkansas are hereby accepted by the City of Jonesboro and hereby assigned and attached to Ward 2 of the City of Jonesboro, Arkansas
Section 4: The lands and territory annexed to the City of Jonesboro, Arkansas are hereby designated and zoned as R-1.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that it is in the interest of the City of Jonesboro that the citizens and property of said territory set out above be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed in order to allow the growth and development of said lands and territory. Therefore an emergency is hereby declared to exist and this ordinance is necessary for the preservation of the public peace, health and safety.
PASSED and ADOPTED this 16th day of August 16, 1976.
