Minutes of the June 14, 1994 meeting were approved as mailed.
#1 SU94-10 Jon and Dawn Gambill requested approval of placement of a mobile home at 1711 North Church Street.
Mr. McCracken made a motion to approve subject to the plat being prepared to satisfaction of staff. Mr. Damron seconded the motion with seven voting aye, 0 no, REQUEST APPROVED.
#2 SP94-14 Wal-Mart Stores, Inc. requested approval of plans for expansion of the Garden Center at Wal-Mart Supercenter located at 1815 East Highland Drive. The expansion contains approximately 6,000 square feet.
There was a long discussion of previous meetings with Wal-Mart concerning completion of the retention basin that was included in the original Supercenter proposal some three years ago. It was noted that a letter was received in July of 1993 stating the basin would be completed independently of the Sam's site by 11-1-93. The sites have changed for various reasons and each plan included completion of the basin but actual work has never been completed. There were also concerns about the steepness of the new exit ramp and also the 90 turn in 28 feet for two way traffic. Assurances were given by CEI Engineering that vehicles could safely maneuver the turns. The existing drive is presently curved to the south and will become a straight drive in front of the building. CEI representatives stated that local store persons were responsible for general property maintenance that would include the retention basis.
Mr. McCracken made a motion to approve the request with the following stipulations:
1. Prior to issuance of building permit the City Engineer and staff must approve the status of the old retention basin
2. Maintenance being performed on the site on a consistent basis
3. Site plans being submitted to city staff for approval of outside storage for seasonal merchandise
Ms. Finley seconded the motion with six voting aye, one abstaining, 0 no, REQUEST APPROVED WITH STIPULATIONS.
#3 SP94-15 Wal-Mart Stores, Inc. requested approval of revised plans for the Sam's Wholesale Club site. The property is located on the West side of Caraway Road, North of Race Street.
People from Forest Home Nazarene Church, Fred Dacus of Fred Dacus and Associates and a property owner on the north side of the Sam's site were in attendance and all voiced objections to the metal building plans that were presented on this item. Ms. Grelle of CEI Engineering explained that because of building cost, problems in getting concrete and masons, Wal-Mart changed to this format. Ms. Grelle further stated that things were not financially good for Sam's right now and also spoke of several other cities where Sams is locating in the near future. Also, it was noted that because of trees that will be left or transplanted in the area, the building will hardly be visible from Caraway Road. The site will be well screened on all sides with fencing in certain areas as well as the trees. In answer to the beginning of construction, Ms. Grelle stated possibly late fall or early next year.
Ken Stallings stated that the Sams in Overland, Kansas was bricked and is a beautiful building.
Ms. Shaw made a motion to deny the request based on the building type being out of character with the area. Ms. Shaw also stated that the economy here would justify the enhanced block building. Ms. Finley seconded the motion, 3 voting aye, 3 voting no, 2 abstaining, REQUEST DENIED.
#4 FP94-12 The Kelso Firm requested final approval of plans for Murray Creek Subdivision, Phase IV and a replat of Lots 45-49 and Lot 51 of Murray Creek Phase III. The proposal contains 28 lots on 9.25 acres. The property is located on the East side of Paragould Drive, on the North and South sides of Mockernut Drive.
Mr. McCracken made a motion to approve the request subject to:
1. Engineer's comments in regards to design of drainage improvements on Mockernut
2. Staff review and City Council approval of document for proposed improvement on Mockernut
3. Abandonment of street right of ways and easements on Murray Creek being completed and approved by City Council
4. No building permits being issued in Phase IV until Paragould Drive is fully improved as approved in other phases

#5 RP94-38 Gerald Marlar requested approval of a replat of Marlar Replat of Lot 1-A of Home Federal Replat of Lot 1 of Ranchette Acres. The property is located on the North side of Ranchette Drive, West of Crescendo Drive.
There were several in the audience who objected to more multi-family units being built in this neighborhood. Many felt that the duplex on each lot was as far as development needed to go. Petitions containing signatures of many area residents were submitted in opposition to this proposal. A decline in property values was also stated as being a fear if more apartments are built in the area.
When asked if he would desire the replat without the site plan approval, Mr. Marlar responded that he would not.
Ms. Finley made a motion to deny the replat, seconded by Mr. Damron. Five voted aye, one voted no, one absent, REQUEST DENIED.
#6 SP94-13 Gerald Marlar requested approval of site plans for an eight unit apartment complex to be located on the North side of Ranchette Drive, West of Crescendo Drive.
