AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGE IN ZONING BOUNDARIES FROM R-1 TO C-3 LOCATED NORTH OF WILKINS AVENUE AND NETTLETON AVENUE, R-2 TO C-3 LOCATED ON LOT 12 OF THE KIECHS THIRD ADDITION, R-2 TO C-3 LOCATED ON LOTS 9-12 OF KIECHS FIRST ADDITION AND R-2 TO C-2 ON LOTS 9, 17, 18 AND 19 OF HOMER PARR ADDITION

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That Ordinance No. 954 known as the Zoning Ordinance of the City of Jonesboro to be amended as recommended by the Metropolitan Area Planning Commission by the change in zoning district boundaries as follows:

 

(a) From Residential (R-1) to Commercial (C-3) of property described as follows: The South 900 feet of the following described tract of land: Part of the Northeast Quarter of the Southeast Quarter of Section 20, Township 14 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Southwest corner of the Northeast Quarter of the Southeast Quarter of Section 20, aforesaid; thence North 89 degrees 16 minutes East along the South line of said Northeast Quarter of the Southeast Quarter of a distance of 198.6 feet; thence North 0 degrees 04 minutes West 30 feet to the point of beginning proper; thence continue North 0 degrees 04 minutes West 988.2 feet; thence North 89 degrees 42 minutes East 126 feet; thence North 0 degrees 04 minutes West 300 feet to the North line of said Northeast Quarter of the Southeast Quarter, thence North 89 degrees 42 minutes East along said North line 126 feet; thence South 0 degrees 04 minutes East 1286.3 feet to the North right-of-way of Wilkins Avenue; thence South 89 degrees 16 minutes West along said right-of-way 252 feet to the point of beginning proper, and containing 6.58 acres, more or less, and being subject to the right-of-way for Nettleton Avenue along the North side of the tract as shown on the plat.

(b) From Residential Two (R-2) to Commercial Three (C-3) of the following property described as follows: Lot 12, being a re-plat of Lots 10, 11 and 12 of Kiechs Third Addition to the City of Nettleton, Arkansas.

(c) From Residential Two (R-2) to Commercial Three (C-3) of the property described as follows: Lots 9, 10, 11 and 12 of Kiechs First Addition to the City of Nettleton, Arkansas.  

(d) From Residential Two (R-2) to Commercial Two (C-2) of the property described as follows: Lots 9, 17, 18 and 19 of Homer Parr Addition to Jonesboro, Arkansas.

 

Section 2: It is found and declared by the City Council that proper use of the tracts of land described in this Ordinance is being delayed because of improper zoning and that, therefore, an emergency exists and this Ordinance being necessary for the preservation of the public peace, health and safety it shall take effect from and after its passage and approval.
