AN ORDINANCE ACCEPTING CERTAIN LANDS TO THE CITY OF JONESBORO, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD FIVE: ZONING SAID ANNEXED TERRITORY COMMERCIAL FOUR C-4: DECLARING AN EMERGENCY: AND FOR OTHER PURPOSES

WHEREAS, the City of Jonesboro, Arkansas, desires to annex certain lands to the City of Jonesboro, Arkansas, hereinafter described; and

 

WHEREAS, said lands are completely surrounded by lands incorporated in to the City of Jonesboro; and

 

WHEREAS, the City of Jonesboro has held a public hearing within sixty days of the proposal of this ordinance at which hearing individuals were allowed to appear and present their views on the proposed annexation: and

 

WHEREAS, the City of Jonesboro published a legal notice setting out the legal description of the territory proposed to be annexed at least fifteen days prior to the date of said public hearing; and

 

WHEREAS, the City of Jonesboro did notify by certified mail all the property owners within the area proposed to be annexed of their right to appear at the public hearing to present their views on the proposed annexation; and

 

WHEREAS, the City of Jonesboro intends to extend police and fire protection, garbage pickup and street maintenance into the said territory; and

 

WHEREAS, the said territory to be annexed, complies with the standards for lands qualifying for annexation which are set forth in Section 1 of Act 298 of 1971 as amended.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section l: The territory and lands hereinafter described are hereby accepted and annexed by the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (McMillan and Reed, 619 W. Parker Rd., - Joe Tomlinson)

 

“Part of the Northwest Quarter of the Northwest Quarter of Section 31, Township 14 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Northeast corner of the Northwest Quarter of the Northwest Quarter of Section 31, aforesaid: thence South 73 degrees 16’30” West 219.1 feet to a point on the South right-of-way line of High-way #63 By-Pass; thence South 82 degrees 40’30” West along said right-of-way 16.0 feet; thence South 89 degrees 44’ West along said right-of-way 534.3 feet to the point of beginning proper; thence South 0 degrees 06’ East 167.7 feet; thence North 89 degrees 37’ West 80 feet; thence North 0 degrees 06’ West 166.8 feet to the South Right-of-way line of Highway #63 By-Pass; thence North 89 degrees 44’ East along said right-of-way 80 feet to the point of beginning proper, and containing 0.307 acres, more or less.

 

Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward four of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Commercial (C-4).

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now and in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effects and be in full force from and after its passage.
