AN ORDINANCE TO PROHIBIT THE PARKING OF VEHICLES IN EXCESS OF 20 FEET UPON THE CITY STREETS AND CITY RIGHT-OF-WAY; PROVIDING A PENALTY FOR VIOLATION THEREOF AND FOR OTHER PURPOSES

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: It shall be unlawful for any person, firm, corporation, association or partner-ship, to park or caused to be parked, any motor vehicle, travel trailer, or trailer that is in excess of 20 feet long upon certain streets and street right-of-ways within the City of Jonesboro, Arkansas.

 

Section 2: The streets and street right-of-ways within the City of Jonesboro where the parking of the above vehicles are prohibited are those streets and street right-of-ways located within areas of the City zoned residential R-1, residential R-2 or residential R-3.

 

Section 3: The street right-of-way is defined, as that area of land lying between the centerline of the existing street, to the lot line of abutting real property.

 

Section 4: This Ordinance shall not prohibit or restrict the parking of municipal vehicles and equipment or utility company vehicles or equipment, within the existing streets and street right-of-ways as designated in this Ordinance in the performance of required duties.

 

Section 5: This ordinance shall not prohibit or restrict the parking of any vehicle while in the actual process of loading or unloading household goods, construction materials or equipment to service any residentially zoned area that directly abuts a street right-of-way as set forth in this Ordinance.

 

Section 6: A violation of any provision of this Ordinance shall constitute a misdemeanor and upon conviction thereof a person may be fined up to $100.00 for each violation. Each day such violation continues shall constitute a separate offense for the purposes of this Ordinance.

 

Section 7: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance shall be declared unconstitutional by the valid judgment or decree of a court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences and paragraphs of this Ordinance.

 

Section 8: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.

 

Section 9: It is hereby found and declared by the City Council that due to the fact that certain vehicles in excess of 20 feet are being parked upon City streets and City street right-of-ways and that the parking of these vehicles constitute an obstruction to vision and hazard to motorists driving upon City streets, that there is a great possibility that failure to institute this Ordinance shall constitute a traffic hazard, therefore, an emergency is hereby declared to exist and this Ordinance shall take affect and be in full force from and after its passage and approval.
