AN ORDINANCE TO AMEND SECTION 13-37 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, THE SAME DEALING WITH THE REGULATION OF PAWNBROKERS

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that Section 13-37 be amended as follows:

 

Section 1: In addition to the license fee which is now or may hereafter be collected every year from persons engaged in the pawnbrokers business, such person shall be subject to the following additional regulations in the conduct of their business as a pawnbroker:

 

(a)                     It shall be the duty of each pawnbroker, his or its agents, servants and employees, to keep in a plain and intelligent manner, a written record in a permanent record book of each transaction in which a pawnbroker lends, advances, or pays money or anything of value, on which personal property is pledged, sold, bartered or exchanged. The following information shall be ordained by the pawnbroker, his or its agents, servants and/or employees, and placed in the permanent record book -

 

1.                     The name of the person conducting the transaction and that person’s address;

2.                     The driver’s license number, social security number and thumbprint of the person conducting the transaction;

3.                     A description of the items pledged, sold, bartered or exchanged; In lieu of either a driver’s license number or social security number, a credit card, -in- current effect, may be substituted for either the driver’s license or social security number.

 

Section 2: In addition to the information being placed by the pawnbroker, his or its agents, servants and/or employees in the permanent record book, the pawnbroker, his or its agents, servants and/or employees shall place the above information upon a form to be provided by the City of Jonesboro, Arkansas, and it shall be the duty of every pawnbroker, his or its agents, servants, and/or employees to place the information required in Section 1 (a) (1,2,3) above in the form provided by the City of Jonesboro, Arkansas, and to make available form, which shall recite the previous day’s business, to the Jonesboro Police Department, every day before noon, except Sundays.

 

Section 3: Any pawnbroker who fails to provide the daily report or the information required to be placed within said report required in section 1 (a) (1, 2, 3) and 2 of the Ordinance shall be subject to a fine for the first offense of no greater than $100.00; for a failure to provide the information required in Section 1 (a) (1, 2, 3) and/or to provide daily reports as required in Section 2 above, a second time, the pawnbroker shall be fined no more than $500.00; and for each subsequent offense, the pawnbroker shall be subject to affine of not more than $1,000.00 or no more than 30 days in jail, or both.

 

Section 4: Such permanent record book shall be kept upon the business premises of the pawnbroker and shall, at all times, be subject to inspection by the Chief of Police, and police officer on duty, the Sheriff of Craighead County or any Deputy Sheriff of Craighead County and the City Attorney upon demand by any of them.

 

Section 5: The pawnbroker, his agents, servants and/or employees, shall in all cases were such article or personal property is still in possession of the pawnbroker and/or his agents, servants and/or employees, permit any of said law enforcement officers, described in Section 4 above to inspect said article or articles upon demand.

 

Section 6: Pawnbroker shall be defined as to include any person, firm, association corporation or agent thereof, who is engaged in the business of lending money upon the security of articles of personal property and who retains passion of such articles until the loan is repaid.

 

Section 7: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.

 

Section 8: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that increasing quantities of stolen merchandise is being pawned and that the City of Jonesboro’s police Department and Sheriff’s Department need to better regulate pawnbrokers and the merchandise received by pawnbrokers, and therefore, this Ordinance being necessary for the preservation of the public peace, health and safety, and emergency is hereby declared to exist this Ordinance shall take effect from and after its approval.
