AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED NOVEMBER 13, 1972; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5, DECLARING AND EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, Western District, on October 9, 1972; and
WHEREAS, said petition for the annexation of said land was signed by a majority of the real estate owners, owning more than one-half of the acreage affected and to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published for said hearing, and a hearing upon said petition was duly had and held in the County Court on November 13, 1972, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and,
WHEREAS, thirty (30) days has expired since the order of annexation dated November 13, 1972, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Western District of Craighead County, Arkansas,
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, by its order of November 13, 1972, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein, shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to the City and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
The Southeast Quarter of the Southwest Quarter, of Section 26, Township 14, Range 3 East, in the Jonesboro District. The Northwest Quarter of the Northwest Quarter, the Northwest Quarter of the Southwest Quarter, the Northwest Quarter of the Northeast Quarter, the West ½ of the Southeast Quarter of the Northeast Quarter, the North ½ of the North ½ of the Southwest Quarter of the Northeast Quarter, Griffin Subdivision of the East ½ of the Northwest, all in Section 35, Township 14, Range 3 East, Valley District, containing 270 acres.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5, of the City of Jonesboro, Arkansas.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the city’s next census counts; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that same be annexed to the City so that the said territory that is set out above can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
PASSED and ADOPTED this 4th day of March, 1974.
