MINUTES

METROPOLITAN AREA PLANNING COMMISSION 

JULY 11, 1995 

 

MEMBERS PRESENT: Coleman, Little, Damron, McCracken, Beadles, Pitts, Shaw, Phillips

 

MEMBERS ABSENT:  Finley 

 

Minutes of the June 13, 1995 meeting were approved as submitted. 

 

#1  RZ95-26  Arkansas State University requested approval of rezoning from R-1 to C-3 for 10.97 acres located on the East side of Browns Lane, south of Race Street and West of McClellan Drive. 

 

Ms. Shaw moved to approve the request with the street right of way being addressed at the platting and development stage.  Mr. Damron seconded, 7 voted aye, 0 no REQUEST APPROVED. 

 

#2 RZ95-27 Arkansas State University requested approval of rezoning from R-2 to C-3 for 5.01 acres located on the North side of East Washington Avenue, West of the intersection of Matthews Avenue. 

 

Mr. Damron moved to approve the request with the right of way being addressed at the platting and development stage.  Mr. Little seconded with 7 voting aye, 0 no, REQUEST APPROVED. 

 

#3 RZ95-28 Arkansas State University requested approval of rezoning from R-2 to C-3 for 5.19 acres located on the North side of East Matthews Avenue, West of the intersection of Washington Avenue. 

 

Mr. McCracken moved to approve the request subject to addressing right of way and street encroachment at platting stage.  Mr. Damron seconded, 7 voted aye, 0 no, REQUEST APPROVED.                     

 

#4 RZ95-21 Melissa Meredith requested approval of rezoning from R-1 to I-1 for Lots 1, 2, 3, 4 and 5, all in Block B of Apple Hills Subdivision.  The property is located on the East side of Warren Street, between Jonathan Street and Daybreak Drive. 

 

Item WITHDRAWN by owner prior to meeting. 

 

#5 FP95-12 Kent Arnold requested final approval for subdivision plans for Cayman Place containing 38 lots on 10 acres.  The property is located on the North side of Harrisburg Road, East of Caraway Road and West of Stadium Boulevard. 

 

A letter from Arkansas Electric Cooperative Corp. discussed their 100 foot right of way being used in conjunction with a street being built in this right of way.  They asked to be assured their poles remain outside the street right of way a minimum of 10 feet, so that they might upgrade their lines at a later date.  They also want to see the final plan before development is begun and permits are issued.

 

Mr. McCracken made a motion to approve subject to:

 

1.  The Engineer's comments for a ditch excavation, CMP drainage tiles need to be bituminous coated

2.  Details for concrete swale to be approved by City Engineer and his staff review that swale is appropriate 

3. Relocate Street 5' to north

4.  Alternate name for Jennifer Lynn Cove 

5.  Impose 30' setback on cul-de-sacs 

6.  10' utility easement on both sides of Caribbean Place 

7.  Acceptance by AECC on final plan

 

It was stated that extreme caution should be exercised on behalf of the developer and others involved in the preparation of plot plans and those on the site actually placing the homes considering the enlarged setbacks not normally seen in R-3 and the relocation of one street from the center of the right of way.

 

Mr. Damron seconded, 6 voted aye, 0 no, one abstained, REQUEST APPROVED WITH STIPULATIONS. 

 

#6 FP95-11 Phillips Construction Company requested preliminary approval of Rossland Hills Phase II containing 24 lots on 11.94 acres.  The property is located on the West side of Harrisburg Road and is a continuation of Rolling Forest Drive and Brandywine Drive. 

The agenda erroneously listed this as a final request.  It should be preliminary. 

 

Mr. McCracken moved to grant preliminary approval subject to:

 

1.  Engineer's comments on drainage easement on Lot 9

2.  Revision on drainage to keep water underground on Lots 1 and 2, Block D

3. Alternate Street names being selected as necessary

4.  Signatures and professional seals on final plat

5.  City Engineer looking at Kay Drive to determine whether it is beneficial for that street to be dedicated and improved to property line

 

Ms. Shaw seconded, 6 voted aye, 0 no, one abstained, REQUEST APPROVED WITH STIPULATIONS. 

 

#7 PP95-11 Mitchell Caldwell requested preliminary approval of plans for Colony Park 4th Addition.  The property is located on the South side of Colony Drive, West of Richardson Road. 

 

Mr. McCracken made a motion to grant preliminary approval subject to:

1.  Drainage easements in Engineering Comments 

2.  Sewer easements in Utility Comments 

3.  Right of way on Richardson being shown 60' from section line

4.  Redrawing so that utility easement would lie in conjunction with Richardson

5.  Drainage coming off Jeridon Cove between Lots 6 & 7 being underground pipe

6.  City Engineer looking at ditch on Richardson Road to determine what improvements need to be made to make it maintainable

 

Ms. Shaw seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#8 SP95-9 Mike Watson requested approval of site plans for two apartment buildings to be located on a 1.5 acre lot.  The property is located on the West side of Leslie Ann Drive, North of Barbara Ann Drive. 

 

Mr. Watson gave an explanation as to how his apartments will be built, a density comparison on his 1.5 acre lot compared to the 100' lot around the corner, and explained the Bill of Assurance specifically allowing apartments on Lot 4 of Meadowlark Acres.  He stated that he purchased the property knowing it was zoned R-2 and this is how he wishes to develop the property.  Photos of the existing four-plex were presented to the commission.

 

Mr. Harris, John Hart, Vernon Neal, Sr., Trudy Niederbach, and Vernon Neal, Jr., all residents of the subdivision, and others, spoke in opposition to additional apartments.  Tracy Mooneyham and Glenn Patterson spoke in favor of the apartments.

 

Mr. Watson stated he owned a three acre tract adjoining the apartment complex.  He committed to building single family houses on this tract instead of more apartments if the commissioners would agree to allow this project. 

 

Mr. Pitts moved to deny the request as he is opposed to the addition of more apartments on this lot.  Ms. Shaw seconded, 6 voted aye, one no, REQUEST DENIED. 

 

#9 SP95-10 Alan Taylor requested approval of site plans for an additional building to be placed on a lot that has three existing buildings.  The property is located on the southeast corner of Parker Road and Parker Annex Road. 

 

The building on this site plan has already been placed on the lot without permits or inspections.  The owner stated they were unaware of the requirements and already had the building delivered before contacting the City.

 

Mr. Pitts moved to approve the request subject to paving the parking lot within six months.  Mr. Damron seconded, 6 voted aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATION. 

 

#10 SP95-11 Emerson Funeral Home requested approval of site plans for adding a new chapel to their existing facilities.   The property is located on the South side of Nettleton Avenue, West of Franklin Street. 

 

Parking was discussed in depth.  Stacked parking for the chapel will be utilized and sufficient for the needs of the new chapel.  Access through the Chamber property next door will also be available.  Mr. Emerson owns land behind this property as well. 

The right of way on Nettleton needs to be dedicated at 60' from centerline according to the Master Street Plan.  Mr. Emerson stated that he had no problem with the right of way dedication.

 

A motion to approve the request was made by Ms. Shaw and seconded by Mr. Pitts subject to the right of way dedication Nettleton Avenue according to the MATA Plan.  Voting was 7 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATION.

 

#11 SP95-12 Ridgepointe Development Corp. requested conceptual approval of street plans for the next phases of Ridgepointe.  The property is located on the North side of Woodsprings Road, a continuation of Ridgepointe Drive South of Strawfloor Road. 

 

It was stated that no streets are being dedicated at this time.  This is a conceptual layout of streets and particularly one cul-de-sac street that exceed the maximum length.  The streets will be constructed according to city specifications and will be inspected but will not be dedicated until a later time.

 

A motion to approve the request was made by Mr. Little and seconded by Mr. Damron.  Voting was 6 in favor, 0 opposed, 1 abstained, REQUEST APPROVED.

 

#12  RP95-14  Mark and Hal Rees requested approval of a replat of Lots 30-35, Block F and Lots 7-10, Block I, all in the Belmont Addition.  The property is located east of Greenbriar Drive and is a continuation of Rose Street.  Item WITHDRAWN prior to meeting.
