AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on July 15, 1987; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on August 17, 1987, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated August 17, 1987, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of October 30, 1987.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of August 17, 1987 be and hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Easley, ET AL, N. of Hwy 18 East, Zoned R-2, C-3, and AG)
Tract 1: The East 210 feet of the South 210 feet of the Southwest Quarter of the Southwest Quarter of Section 13, Township 14 North, Range 4 East, Craighead, County, Arkansas, more particularly described as follows: Begin at the Southeast Corner of the Southwest Quarter of the Southwest Quarter of aforesaid Section 13, Township 14 North Range 4 East; thence North 0˚ 36’09” West 210 feet; thence South 89˚23’51” West 210 feet; thence South 0˚36’09” East 210 feet; thence North 89˚23’51” East to the point of beginning proper, containing 1.0 acres, more or less, and being subject to a 30 foot road easement along the South side thereof.
Tract 2: A part of the Northwest Quarter of the Northwest Quarter of Section 19, Township 14 North, Range 5 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northwest Corner of the Northwest Quarter of the Northwest Quarter of said Section 19,, Township 14 North, Range 5 East; thence run South 89˚23’44” East 330 feet; thence South 0˚ 36’16” West 210 feet; thence North 89˚23’44” West 330 feet; thence North 0˚36’ 16” East 210 feet to the point of beginning proper, containing 1.59 acres, more or less, and being subject to a 30 foot road easement on the West side thereof.
Tract 3: A tract of land being a part of the Northwest Quarter of the Northwest Quarter of Section 19, Township 14 North, Range 5 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northwest Corner of the Northwest Quarter of the Northwest Quarter of Section 19, Town ship 14 North Range 5 East; thence South 0˚36’16” West on the Section line 316.0 feet to the point of beginning proper; thence North 87˚02’16” East 238.7 feet; thence South 0˚36’16” West 208.7 feet; thence South 208.7 feet to the point of beginning proper, containing 1.10 acres, more or less, and being subject to a 30 foot easement for a county road along the West side thereof.
Tract 4: A tract of land being a part of the Southwest Quarter of the Northwest Quarter of Section 19, Township 14 North, Range 5 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northwest Corner of aforesaid Southwest Quarter of the Northwest Corner of aforesaid Southwest Quarter of the Northwest Quarter of section 19; thence South 0˚36’16” West 98.0 feet to the point of beginning proper; thence North 87˚26’16” East 208.7 feet; thence South 0˚36’16” West 658.1 feet; thence South 87˚26’16” West 208.7 feet to the West line of Section 19; Thence North 0˚36’16” east 658.1 feet along aforesaid West line to the point of beginning proper, containing 3.15 acres, more or less, and being subject to a 30 foot easement for a County Road along the West side thereof.
Tract 5: A tract of land being a part of the Southwest Quarter of the Northwest Quarter of Section 19, Township 14 North, Range 5 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Northwest Corner of the Southwest Quarter of the Northwest Quarter of Section 19: thence South 0˚36’16”West 883.05 feet to the point of beginning proper; thence North 87˚26’16” East 208.7 feet; thence South 0˚36’16” West 208.7 feet; thence South 87˚26’16” West 208.7 feet to the West line of aforesaid Section 19; thence North 0˚36’16” East 208.7 feet along the aforesaid West line of Section 19 to the point of beginning proper containing 1.0 acres, more or less, and being subject to a 30 foot easement for a county road along the West side thereof.
Tract 6: Lots 1 through 11, Newcom Subdivision of a part of the Southeast Quarter of the Southeast Quarter of Section 24, Township 14 North, Range 4 East (123, page 160); and
A tract of land being a part of the Southeast Quarter of the Southeast Quarter of Section 24, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at the Southwest Corner of aforesaid Southeast Quarter of the Southeast Quarter of Section 24, Township 14 North, Range 4 East; thence North 0˚14’09” East 22.94 feet to the centerline of Arkansas Highway No.18 the point of beginning proper; thence continue North 0˚14’09” East 60.0 feet to the North right-of-way line of aforesaid Arkansas Highway No. 18; thence North 88˚53’12” East 582.88 feet along aforesaid North right-of-way line; thence along a curve to the left in a Northeasterly direction having a radius of 2815.72 feet and a length of 100.47 feet; thence North 0˚32’39” East 210.0 feet; thence North 89˚06’39” East 216.4 Feet; thence South 0˚32’39” West 193.5 feet to the North line of aforesaid Arkansas Highway No.18; thence along a curve to the left in a Northeasterly direction having a radius of 2815.72 feet and a length of 144.45 feet to the West line of Newcom’s Subdivision; thence North 0˚36’16” East 1092.00 feet along the West line of Newcom’s Subdivision to the Northwest Corner of Lot 11 thereof; thence North 89˚11’58” East 229.0 feet to the East line of aforesaid Section 24; thence South 0˚36’16” West 1105.92 feet to the centerline of Arkansas Highway No. 18: thence South 77˚29’24” East 123.77 feet Along the centerline of Arkansas Highway No. 18; thence along a curve to the right in a southwesterly direction having a radius of 2875.72 feet and a length of 572.0 feet; thence continue along aforesaid centerline of Arkansas Highway No.18 South 88˚53’12” West 584.30 feet to the point of beginning proper, PLUS a 30 foot right-of-way for Arkansas Highway NO. 18 along the South side of the tract, containing 6.63 acres, more or less.
Tract 7: A tract of land being a part of Section 24, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Beginning at the Northeast Corner of aforesaid Section 24, Township 14 North, Range 4 East; thence South 0˚36’16” West 2629.97 feet; along the East line of aforesaid Section 24 to the East Quarter Corner thereof; thence South 89˚16’09’ West 1287.19 feet; thence South 0˚14’48” West 1316.7 feet; thence South 0˚14’09” West 1293.76 feet to the centerline of Arkansas Highway No. 18; thence South 88˚53’12” West 2591.56 feet along aforesaid centerline of Arkansas Highway No.18; thence North 0˚07’36” West 2626.66 feet; thence North 89˚13’52” East 1321.57 feet thence North 0˚00’41” East 2535.4 feet; thence South 89˚23’51” West 1325.22 feet; thence North 0˚03’38” West 100.0 feet to the North line of Section 24; thence North 89˚23’51” East 1974.58 feet along aforesaid North line; thence South 0˚07’36” West 1317.19 feet; thence North 89˚ 20’52” East 646.56 feet; thence North 0˚14’30” East 1316.69 feet to the North line of aforesaid Section 24; thence North 89˚23’51” East 1302.7 feet along aforesaid North line of Section 24 to the point of beginning proper, being subject to a 30 foot easement for a county road, where applicable, along the North side of the tract and subject to a 30 foot road easement, where applicable, along the East side of the tract, and LESS AND EXCEPT a 60 foot right of way for Arkansas Highway No.18, containing 292.54 acres, more or less.
Section 3.The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 6 of the City of Jonesboro, Arkansas.
Section 5 It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
