ORDINANCE TO VACATE AND ABANDON MAIN STREET AND THAT PORTION OF STROUD STREET ADJACENT TO LOT 11 AND 22 OF MARLO ACRES THIRD ADDITION

WHEREAS, the Petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 18th day of May, 1979, asking the City Council to vacate and abandon all that portion of the streets designated on the plat of Marlo Acres Third Addition to the City of Jonesboro, Arkansas filed February 23, 1970 at 9:30 A.M., and recorded in Plat Book Record 158 page 99 and Melton First Re-plat of Marlo Acres Third Addition to the City of Jonesboro, Arkansas, filed January 14, 1971 at 8:00 A.M., and not appearing of record in Plat Book 179 page 22, in the office of the recorder of Craighead County, described as Main Street and that portion of Stroud Street adjacent to Lots 11 and 22.
WHEREAS after due notices as required by law, the Council has at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the streets or the portion thereof, heretofore described, have heretofore been dedicated to the public use as streets, herein described; have not been actually used by the public generally for a period of at least five years, subsequent to the filing of the plat; that all of the owners of the property abutting upon the portions of the streets to be vacated have filed a written consent to such abandonment; and the public interest and welfare will not be adversely affected by the abandonment of such streets.
NOW THEREFORE be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas hereby releases, vacated and abandons all the rights, together with the right of the public generally, in and into the streets designated as follows:
Main Street and that portion of Stroud Street adjacent to Lots 11 and 22 as platted and dedicated by the plat of Marlo Acres Third Addition to the City of Jonesboro, Arkansas filed February 23, 1970 at 9:30 A.M., and recorded in Plat Book Record 158 page 99 and the plat of Melton First Re-plat of Marlo Acres Third Addition to the City of Jonesboro, Arkansas, filed January 14, 1971 at 8:00 A.M., and now appearing of record in Plat Book 179 page 22 in the office of the recorder of Craighead County.
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County.
Section 3: That, this Ordinance shall take affect and be enforced from and after its passage.
