RESOLUTION TO AUTHORIZE NOTIFICATION TO DEVELOPERS AND HOMEOWNERS UNDER CONSTRUCTION AT THE TIME OF ANNEXATION TO CONTACT THE BUILDING INSPECTOR

WHEREAS, the City of Jonesboro, Arkansas did annex 23 square miles of land into the City Limits as of April 7, 1989; and
WHERES, that at the time of annexation, a number of residential sub-divisions were under development and a number of residential dwellings and mobile homes were under construction or in the process of being established; and
WHEREAS, most of the residential sub-divisions under development a the time of annexation had not been submitted for review by the Metropolitan Area Planning Commission and most of the residential dwellings under construction and mobile homes being established had not been issued building permits for such construction and establishment; and
WHEREAS, the Planning and Inspection Department of the City of Jonesboro, Arkansas requires information on the status of these subdivisions, residential dwellings and mobile homes as of April 7, 1989 in order to determine whether the City should accept the subdivision streets for maintenance, whether building permits should be required and whether utilities can be connected to the new residential dwellings and mobile homes; and
WHEREAS, the most expeditious manner to obtain the information on the status of the sub-divisions is to notify developers and property owners that they must provide information to the Building Inspector on the condition of construction of their sub-division, residential dwelling or mobile home as of April 7, 1989 by placing a legal notice in a newspaper of general circulation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jonesboro, Arkansas, that the City Clerk is directed to publish a public notice once a week for two (2) consecutive weeks advising the public that sub-division developers, residential dwelling property owners and mobile home owners have thirty (30) days from the date of the publication of the last Legal Notice to notify the Building Inspector by written Affidavit, signed and sealed by a duly authorized Notary Public, of the exact status of development of their sub-division (s), construction of their residential dwelling(s), and/or establishment of their mobile home(s).
BE IT FURTHER RESOLVED that failure of a developer, residential dwelling property owner or mobile home owner to supply the Building Inspector with the required Affidavit will result in:
(A) Denial of building permits in a sub-division until full Metropolitan Area Planning Commission review and Seal of Approval have been obtained, including meeting all City specifications for streets and other improvements:
(B) Denial of authorization to establish permanent electric power and/or City Water at the residence or mobile home; and
(C) All such sub-divisions, residential dwellings and mobile homes being subject to all City Sub-division, Zoning, and Building Codes, including issuance of building permits.
