AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MAY 15, 1978, ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed with the County Court of Craighead, County, Arkansas, Western District, on April 8, 1978; and

 

WHEREAS, said petition for annexation of said lands was signed by all the real estate owners owning acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an order setting a hearing on said petition was entered, notice was duly published of said hearing, and hearing was duly had upon said petition in the County Court on May 15, 1978, at which hearing it was duly found and declared by the Court that said petition for annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and

 

WHEREAS, thirty days have expired since the Order of Annexation dated May 15, 1978, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Western District of Craighead County, Arkansas;

 

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas;

 

Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, dated May 15, 1978, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereinafter be deemed and taken to be part and parcel of the limits to the City of Jonesboro, Arkansas, and the inhabitants within the new annexation shall have and enjoy all rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

A part of the North Half of the Northwest Quarter of Section 32, Township 14 North, Range 4 East, being more particularly described as follow: Begin at the Northeast Corner of the Northwest Quarter of Section 32, Township 14 North, Range 4 East; thence West on the Section line 1215.77 feet to the point of beginning proper; thence continue West on the Section line 332.2 feet; thence South 1 degree 12’ West 1311.36 feet to the South line of aforesaid North Half of the Northwest Quarter of Section 32; thence South 89 degrees 57’ East on the 40 ace line 332.2 feet; thence North 1 degree 12’ East 1311.6 feet to the point of beginning proper, containing 10 acres. Subject to Parker Road, power line, gas easement and a 60 foot right-of-way by City ordinance all along and off the North side, Higginbottom Creek off the South side, sanitary sewer with easement for same and an underground telephone cable all as shown or indicated on plat.

 

Section 3: The lands and territories annexed to the City of Jonesboro, Arkansas, and accepted by the City are hereby assigned and attached to Ward 5.

 

Section 4: The lands and territories herein annexed to the City of Jonesboro, have been zoned C3.

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that the immediate plans for development of area hereby annexed to the City of Jonesboro, Arkansas require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.

 

PASSED and ADOPTED this 7th day of June, 1982.
