ORDINANCE TO VACATE AND ABANDON AN ALLEY BETWEEN WOFFORD AND RAINS STREETS

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 2nd day of March, 1959, asking the City Council to vacate and abandon an alley between Block 2 of B.M. Mackey's Subdivision of Block 11 of Senter & Company Addition, and Block 14 of Senter & Company Addition to the City of Jonesboro, Arkansas as shown on plat of said blocks, the same appearing in Deed Record 23, page 485 in the office of the Circuit Clerk at Jonesboro, Arkansas, designated as follows, to-wit:
Beginning at the Southeast corner of Lot 5 of Block 2 of B.F. Mackey's Subdivision of Block 11 of Senter & Company Addition to the City of Jonesboro, Arkansas; thence South 10 feet to the Northeast corner of Block 14 of Senter & Company Addition; thence West to the Northwest corner of Block 14 of Senter & Company Addition; thence North to the Southwest corner of Lot 1 Block 2 of B.F. Mackey's Subdivision of Block 11 of Senter & Company Addition; thence East to the point of beginning, being an alley 10 feet North and South and 600 feet East and West lying between Wofford and Rains Street in the City of Jonesboro.
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley hereinabove described has heretofore been dedicated to the public use as an alley; has not been actually used by the public generally for a period of five (5) years prior to the filing of the Petition for Abandonment; that all owners of property abutting the alley to be vacated have filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro:
SECTION 1: The City of Jonesboro, Arkansas hereby releases, vacates and abandons all its right, together with the rights of the public generally, in and to the alley designated as follows:
Beginning at the Southeast corner of Lot 5 of Block 2 of B.F. Mackey's Subdivision of Block 11 of Senter & Company Addition to the City of Jonesboro, Arkansas; thence South 10 feet to the Northeast corner of Block 14 of Senter & Company Addition; thence West to the Northwest corner of Block 14 of Senter & Company addition; thence North to the Southwest corner of Lot 1 Block 2 of B.F. Mackey's Subdivision of Block 11 of Senter & Company Addition; thence East to the point of beginning, being an alley 10 feet North and South and 600 feet East and West lying between Wofford and Rains Street in the City of Jonesboro.
SECTION 2: A copy of the Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of the County and recorded in the Deed Records of the County.
SECTION 3: This Ordinance shall take effect and be in force from and after its passage.
