PUBLIC HEARING - 6:15 P.M. - The Public Hearing requested by Mr. Ben Flynn was cancelled due to conflicting land surveys.

 

CITY COUNCIL MINUTES, OCTOBER 16, 1995

 

The Jonesboro City Council met Monday, October 16, 1995, at 6:30 p.m. A full quorum was in attendance. Present were Mayor Brodell, City Clerk, Donna Jackson, City Attorney, Phillip Crego, and ten council members. Those Councilmen were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah. Councilmen Vance and Perrin were unable to attend the meeting.

 

The minutes of October 2, 1995, were approved as mailed by Councilman Tate seconded by Councilman Young. A roll call vote was taken resulting in all council members voting aye. Those Councilmen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah.

 

Councilman Gary Harpole, Chairman of the Personnel Committee informed city employees and council members of a hearing scheduled for October 26, 1995, at 6:30 p.m. for the purpose of answering any questions regarding the salary plan. Mr. Harpole urged everyone to write down questions they may have and give them to the Personnel Director before the hearing. At the request of Councilman Harpole, Dr. Dan Hoyt explained how he developed the salary plan.

 

Items 4-A and 4-B were both pulled from the agenda. Item 4-A was an ordinance for Mr. Ben Flynn and Item 4-B was a rezoning for Schwan's Sales Ent. which contained no ordinance.

 

Councilman Kelton offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Rubin Griffin)

 

Mr. Brian Wadley, Planning and Inspection Director stated Mr. Griffin has been asked to provide a site plan. Councilman Evans moved, seconded by Councilman Wise to suspend the rules and place on the second reading. A roll call vote was taken resulting in a seven (7) to three (3) vote, against the motion. Those Aldermen voting nay were: Rega, Province, Young, Tate, Kelton, Roddy, and Harpole. Those Aldermen voting aye were: Wise, Evans, and Hannah. The motion failed.

 

Councilman Tate offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Pete Gasaway)

 

Councilman Hannah moved, seconded by Councilman Tate to suspend the rules and place on the second reading. A roll call vote was taken resulting in an eight (8) to two (2) vote in favor of the motion. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Tate, Roddy, Harpole, and Hannah. Those Aldermen voting nay were: Young and Kelton. The motion passed, and the ordinance was read a second time.

 

Councilman Young offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES. (Mary Lee Blocker)

 

Councilman Tate moved, seconded by Councilman Hannah to suspend the rules and place on the second reading. A roll call vote was taken resulting in a seven (7) to three (3) vote, in favor of the motion. However, in order to suspend the rules a 2\3 vote of the elected body is required. Therefore, the motion for a second reading was denied. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Tate, Roddy, and Hannah. Those Aldermen voting nay were: Young, Kelton, and Harpole. The motion failed.

 

Bid Number 95:42, Municipal Building Landscaping was reviewed by the Council. Councilman Tate moved, seconded by Councilman Kelton to accept the low bid which met bid specifications. A roll call vote was taken resulting in all council members voting aye. Those Councilmen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah.

 

Councilman Young moved, seconded by Councilman Wise to set a public hearing for 6:10 p.m., November 6, 1995, for the purpose of establishing the North East Arkansas (NEA) Cab Company, as requested by Ms. Barbara Halsey. A roll call vote was taken resulting in all council members voting aye. Those Councilmen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah.

 

Councilman Hannah moved, seconded by Councilman Wise for the adoption of a resolution to condemn property located at 505 Paragould Road, located within the City of Jonesboro, Arkansas. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah. The resolution was given the number 1995:61.

 

Councilman Hannah moved, seconded by Councilman Wise for the adoption of a resolution to accepting the findings and determinations for a street improvement district located in Southview Acres. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah. The resolution was given the number 1995:62.

 

Under new business, Councilman Young offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND CHAPTER NINE (9) OF THE JONESBORO MUNICIPAL CODE - STREETS AND SIDEWALKS

 

Councilman Harpole moved, seconded by Councilman Young to suspend the rules and place on a second reading. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Evans raised the question of streets being 6 feet wide to meet ADA standards. Councilman Tate raised questions regarding drive-over curbs for subdivisions.

 

Doug Little, Code Enforcement Officer, reported to the Council on a method used by the City of Blytheville, by which in-house employees and public service workers are utilized to clear condemned areas, rather than paying for outside help. Councilman Hannah questioned the true savings in the program, if city employees are taken from the job they were hired to do, and expected to do additional work.

 

Councilman Young offered the following ordinance for the first reading:

 

AN ORDINANCE TO WAIVE BIDS FOR THE PURCHASE OF BRIDGE PANELS (PEACHTREE)

 

Councilman Evans moved, seconded by Councilman Tate to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Evans moved, seconded by Councilman Tate to further suspend the rules and place on the third and final reading. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah. Councilman Evans moved, seconded by Councilman Harpole for the adoption of the ordinance. The ordinance was given the number 2661.

 

Councilman Rega moved, seconded by Councilman Hannah to accept the low bid meeting specifications on a reserve power source for the E-911 Center. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Wise, Rega, Evans, Province, Young, Tate, Kelton, Roddy, Harpole, and Hannah.

 

With no further business the meeting was adjourned.
