CITY COUNCIL MINUTES - JANUARY 20, 1986

 

The Jonesboro City Council met at 7:30 p.m. Present were Mayor, City Clerk, City Attorney, and Aldermen Park, Stricklin, Evans, Hinson, Shelton, Hannah, Strauser, Culpepper, Sanderson, Mays and Nix. Aldermen Bridger was absent.

 

The minutes of January 6, 1986, were approved as mailed on motion by Mr. Stricklin, seconded by Mr. Park. All voted aye.

 

Mr. Shelton offered the following resolution:

 

RESOLUTION TO NAME JUDGES, CLERKS AND ALTERNATE WORKERS FOR THE CITY WATER AND LIGHT PLANT ELECTION OF 1986

 

Mr. Hinson moved, seconded by Mr. Shelton to adopt the resolution. All voted aye. The resolution was given the number 1986:01.

 

Mr. Mays offered the following ordinance: (Annexation- Greenleaf 2712 E. Johnson)

 

AN ORDINANCE ACCEPTING CERTAIN LANDS, ZONED C-5, ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, LOCATED IN WARD 3, BY ORDER OF THE COUNTY COURT DATED 1/17/86.

 

Mr. Nix moved, seconded by Mr. Culpepper to suspend the rules and place on second reading. All voted aye. Attorney Stan Langley representing Greenleaf Health Systems, Inc. addressed the issue. Attorney Donn Mixon representing several property owners at the northeast of the city limits spoke in opposition. Numerous property owners voiced opposition to the proposed site.

 

An Ordinance to trade property with St. Bernard’s Hospital was withdrawn from consideration due to several errors in the document on motion by Mr. Sanderson, seconded by Mr. Culpepper. All voted aye.

 

Mr. Sanderson offered a revised ordinance:

 

AN ORDINANCE AUTHORIZING THE TRANSFER AND EXCHANGE OF REAL ESTATE BY AND BETWEEN THE CITY OF JONESBORO AND ST. BERNARD’S HOSPITAL, INC.

 

Mr. Nix moved, seconded by Mr. Sanderson to suspend the rules and place on second reading. All voted aye. Mr. Nix moved, seconded by Mr. Evans to suspend the rules and place on third reading. All voted aye. Discussion followed. Mr. Hinson reported the Downtown Parking Commission recommended the adoption of the ordinance. Ben Owens, representing St. Bernard’s property swap and land sale to the Council. Attorney Warren Dupwe who maintains a private practice at 220 E. Washington opposed the sale and stated the City did not advertise for bids on the sale of the four lots on the east side of East Street between Washington and Monroe. He added that the property swap of the 4 city lots on the south side of Washington between Carson and Church would amount to a 3 to 1 swap for the property. Mr. Howard Studdard, officer of the Dental Clinic addressed the issue stating his employees would not have accessible parking and questioned the legal description in the ordinance in that it included a portion of his property.

 

Mr. Nix complimented St. Bernard’s Hospital officials on the service they provided to the area, and for the fine medical facility that residents have access to. Mr. Nix moved, seconded by Mr. Sanderson to adopt the ordinance. All voted aye. The ordinance was given the number 1965.

 

Mayor Stallings told Aldermen he had rescinded an order he issued last July for fire and police personnel to call Emerson Ambulance Service for emergency ambulance service. He added that the City Attorney had advised him the city could be subject to civil suit if the services of Emerson and Patient Transfer Service are not called on a rotation basis. He further stated that the intent of the original memorandum was made in the interest of the people because Emerson had the most advanced rating given by the State Health Dept. to ambulances. The new order will take into consideration which ambulance service is the closest proximity to the emergency situation when a call is placed. Mr. Sanderson requested the City Attorney to research the regulations and liability of ambulance service in the city.

 

Mr. Sanderson moved, seconded by Mr. Stricklin to reappoint Beth Couch, 5323 E. Nettleton to the Advertising and Promotions Commission with her term to expire 2/89. All voted aye.

 

The Mayor welcomed students from ASU and Boy Scout Troop 4 of the Knights of Columbus to the Council Meeting. The Troop Leader thanked the Mayor and stated the group was in attendance to study communications.

 

Mr. Culpepper offered the following ordinance: (4-way stop signs, Dupwe & Rosemond - stop sign at Grant & Bernard)

 

AN ORDINANCE PROVIDING FOR CERTAIN TRAFFIC CONTROL DEVICES; TO PROVIDE PENALTIES FOR VIOLATION THEREOF; AND FOR OTHER PURPOSES

 

Mr. Mays moved, seconded by Mr. Culpepper to suspend the rules and place on second reading. All voted aye. Aldermen Sanderson and Hannah voiced objections to the ordinance and stated they would work on an amendment by the next council meeting.

 

The following ordinance was on third reading: (Ag Zoning)

 

AN ORDINANCE TO AMEND ORDINANCE #954, SAME BEING AN ORDINANCE ESTABLISHING ZONING REGULATIONS FOR THE CITY OF JONESBORO, ARKANSAS

 

Mr. Culpepper moved, seconded by Mr. Shelton to amend the ordinance as follows:

 

a) Section 1, line 2: OMIT and Section 10"

b) Section 1, line 3: Change to the singular to read “creating and the regulating of an agricultural district.”

c) Section 3, subsection c, #3: Lot Requirement. Minimum size: Change to “As specified in R-1"

 

All voted aye.

 

Mr. Culpepper further moved, seconded by Dr. Strauser to adopt the ordinance, as amended. All voted aye. The ordinance was given the number 1966.

 

Upon the Mayor’s recommendation, Mr. Park moved, seconded by Mr. Stricklin to raise the salary of the Parks and Recreation Director, Dave Wimpy $1,200 annually retroactive to January 1. His annual salary was $15,425. All voted aye.

 

Mr. Hannah commended the efforts of the Street Dept. in the overlays of streets in the city.

 

With no further business, the meeting adjourned.
