AN ORDINANCE AMENDING ORDINANCE NO. 2549 AND CHAPTER 7.84 OF THE JONESBORO CODE OF ORDINANCES, CREATING A SMOKEFREE ENVIRONMENT IN ALL MUNICIPAL BUILDINGS EXCEPT IN DESIGNATED SMOKING AREAS AS ASSIGNED BY THE MAYOR OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, the Arkansas Clean Indoor Air Act of 2006, effective July 21, 2006, prohibits smoking in all vehicles and enclosed areas owned, leased, or operated by the State of Arkansas, its agencies and authorities, and any political subdivision of the state, municipal corporation, or local board or authority created by general, local, or special act of the General Assembly or by ordinance or resolution of the governing body of a county or municipal corporation individually or jointly with other political subdivisions or municipalities of the state; and
WHEREAS, warnings have been issued by the Surgeon General of the United States concerning the health risk of using tobacco products, and the City of Jonesboro wishes to encourage healthy life styles in their employees;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: Section 7.84.01 entitled Municipal buildings, is hereby repealed and replaced with the following: The use of all tobacco products, be it smoked, chewed, dipped or in any way placed in direct contact with the mouth, is prohibited in all City of Jonesboro owned or leased buildings, vehicles, and equipment.
SECTION 2: Section 7.84.02 entitled Smoking area, is hereby repealed and replaced with the following: Tobacco use areas shall be designated by the Mayor of the City of Jonesboro and shall be located a minimum of 25 feet from any building entrance so as not to affect the Public or any other City employees.
SECTION 3: Section 7.84.04 entitled, Signs is hereby repealed and replaced with the following: Tobacco use areas shall be designated by signs provided by the City Administration.
SECTION 4: Section 7.84.05 entitled Fine, is hereby repealed and replaced with the following: Violation of this Ordinance, as related to all tobacco products other than smoking, which is governed by the Arkansas Clean Air Act of 2006, shall be deemed a misdemeanor offense and punishable by a fine of not less than Twenty-five Dollars, ($25.00) and not more than One Hundred Dollars ($100.00).
SECTION 5: Due to the immediate need to provide a healthy environment for City employees and to promote the public health, safety and welfare, an emergency is declared to exist and this Ordinance shall take effect from and after its passage and approval.
