MINUTES

METROPOLITAN AREA PLANNING COMMISSION

JULY 9, 1996

 

MEMBERS PRESENT:  Coleman, Little, Damron, Gardner, Finley (present through Item 10), Beadles, Pitts, Shaw and Phillips

 

Minutes of the June 11, 1996 meeting were approved as submitted.

 

#1 RZ96-22  Curtis Spence requested approval of rezoning from Residential R-1 to Commercial C-3 for 4.09 acres located on the northeast corner of Caraway Road and Sunnymeadow Drive.

 

Ms. Shaw moved to approve the rezoning as submitted subject to a site plan being submitted and approved by the MAPC before development.  Right of way will be addressed at that time.  Mr. Pitts seconded, 8 voted aye, 0 no,  REQUEST APPROVED WITH STIPULATION.

 

#2 RZ96-23  Phillip A. Jones requested approval of rezoning from Residential R-2 to Residential R-3 for Lot 5 of Knight's First Addition.  The property is located on the south side of Matthews Avenue, between Parr Street and Witt Street.

 

Several area residents were in attendance with all but two in favor of the proposal.  Questions were raised concerning additional housing and on\off street parking.  It was noted that each home has a two car garage plus a drive that is two car lengths wide.  Most driveways come off the interior street not off existing streets.

 

Ms. Shaw made a motion to approve the request acknowledging that the owner stated he would place a deed restriction allowing single family residences only in the development.  Mr. Little seconded, 7 voted aye, 0 no, one abstained, REQUEST APPROVED WITH STIPULATION. 

 

#3 PUD96-3  Phillip A. Jones requested preliminary approval of plans for a residential planned unit development containing 15 units, on 15 lots on 1.54 acres.  The property is located on the south side of Matthews Avenue, between Parr Street and Witt Street.

 

Ms. Shaw moved to give preliminary approval subject to: 

1.  Showing radii on drives

2.  Landscape plan

3.  Drainage plan

4.  POA must be approved by City Attorney

5.  Engineer and surveyor's certification

6.  Fire Department approval on road plan

7.  ROW on Matthews subject to MATA requirement 

 

Ms. Finley seconded, 6 voted aye, 0 no, one abstained, REQUEST APPROVED WITH STIPULATIONS. 

 

#4 RZ96-24  David D. Conrad requested approval of rezoning from Residential R-1 to Commercial C-3 for 2.72 acres located on the west side of Emerald Cove, north of Woodsprings Road.

 

Ms. Finley moved to approve the zoning change subject to proper platting and a site plan being approved by the MAPC before development.  Eight voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#5 RZ96-25  Calvary Pentecostal Church requested approval of rezoning from Residential R-1 to Commercial C-3 for 4.07 acres located on the east side of Caraway Road, south of Harrisburg Road, and west of Stadium Blvd.

 

Mr. Pitts moved to approve the request subject to a site plan being approved by the MAPC before development.  Ms. Finley seconded, eight voted aye, 0 no, REQUEST APPROVED WITH STIPULATION. 

 

#6 RP96-38  Kent Arnold requested approval of a replat of Kent Arnold's Commercial Highway 1 Addition and part of Calvary Pentecostal Church.

 

Mr. Pitts moved to approve the replat subject to finalization on sale of the property from the church and a site plan being approved by the MAPC before development.  Mr. Damron seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#7 SU96-7  Jane Brown requested approval of placement of a mobile home in the 2600 block of N. Church Street.

 

Ms. Shaw moved to approve the request subject to approval from the Health Department on the septic system and Building Inspector's approval.  Mr. Pitts seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#8 RZ96-26  Keith Meredith requested approval of rezoning from Residential R-1 to Residential R-2 for .33 acre located on the southeast corner of Nettleton Avenue and Smoot Drive.

 

Mr. Pitts moved to table item's 8 & 9 due to owner's representative not being able to answer several questions.  The motion was seconded by Ms. Shaw.  Seven voted aye, 0 no, one abstained, REQUEST TABLED.

 

#9 MP96-20  Keith Meredith requested approval of a one lot minor plat containing .33 acre and located on the southeast corner of Nettleton Avenue and Smoot Street.

 

Mr. Pitts moved to table the request, seconded by Ms. Shaw.  Seven voted aye, 0 no, one abstained, REQUEST TABLED.

 

#10 PP96-7  Keith Meredith requested preliminary approval of subdivision plans for Meredith Subdivision Phase II containing 6 lots on 1.55 acres.  The property is located on the south side of Nettleton Avenue, east of Smoot Drive.

 

Item WITHDRAWN by owner's representative.

 

#11 RP96-37  Jim Abel requested approval of a replat of Lot 1, Block A and Lot 1 Block D of Woodland Heights Subdivision.  The property is located on the east side of Culberhouse Street, on the north and south sides of Savannah Drive.

 

Mr. Damron moved to approve the request subject to engineer's and staff comments.  Ms. Shaw seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#12 SP96-17  Tim McDougal requested approval of site plans for a warehouse development to be located on the west side of Liggett Street, south of Johnson Avenue.

 

Dr. Beadles moved to approve the request subject to staff comments on site plan.  Ms. Shaw seconded, 7 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION.

 

#13 SP96-22  James Darnell requested approval of site plans for two living quarters to be added to an existing home at 1115 W.

Jefferson Avenue.

 

Ms. Shaw moved to table the request due to lack of representation and unanswered questions.  Mr. Damron seconded, 7 voted aye, 0 no, REQUEST TABLED.

 

#14 SP96-18  M & W Pizza, Inc. requested approval of plans for a retail center to be located on the east side of Stadium Blvd., north of Race Street and south of Meador Road.

 

Mr. Little moved to table the request for 30 days as plans were late coming in and not reviewed properly by city departments.  Mr. Damron seconded, 7 voted aye, 0 no, REQUEST TABLED.

 

#15 SP96-19  Dwight Mangrum requested approval of site plans for a proposed addition to a commercial building.  The property is located on the northwest corner of Highway 463 and Ingels Road.

 

Dr. Beadles moved to approved the request subject to:

1.  Privacy fence or slats north and east sides of Lot 1

2.  Privacy fence across front

3.  Drainage plan to be reviewed and approved by Staff 

Mr. Pitts seconded, seven voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS. 

 

#16 MP96-18  Ellis Pinchback requested approval of a two lot minor plat containing 4.86 acres and located at 1205 W. Thomas Green Road.

 

Mr. Pitts made a motion to approve the request with the stipulation that a deed restriction be put in place to not allow further subdividing on the property.  Dr. Beadles seconded, 6 voted aye, 0 no, REQUEST APPROVED WITH STIPULATION. 

 

#17 SP96-21  Nuckles and Sons requested approval of site development plans for a 9,570 sf building to be located on the west side of Culberhouse Street, south of Gordon Street.

 

Mr. Little moved to approve the request with the stipulation  that there be controlled access to the property.  Mr. Damron seconded, six voted aye, one no, REQUEST APPROVED WITH STIPULATION.

 

#18 MP96-21  Leroy Richards requested approval of a minor plat containing 12.34 acres and located on the west side of Keller’s Chapel, north of Flemon Road.

 

Several property owners in the area objected to the plat.  At least two owners stated that Mr. Richards had cut trees down on their property without their knowledge or consent.  It was also pointed out that Mr. Richards had attempted to reopen a gravel pit in an area where a previous pit had operated but had not been active for four or five years.  The city's inspection department had accordingly caused the mining operation to cease.  Neither Mr. Richards nor his agent was present to answer any questions or provide information concerning plans for the acreage.

 

Ms. Shaw moved to deny the request because the property has no street frontage, lack of verifiable easement to the property and due to lack of representation they were not able to obtain any information about the property.  Mr. Little seconded, 7 voted aye, 0 no, REQUEST DENIED.
