AN ORDINANCE TO VACATE A PORTION OF AN ALLEY

BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas:
WHEREAS, a petition was duly filed with the City Council for the City of Jonesboro, Arkansas, on the day of April, 1993, to vacate and abandon a portion of an alley described as follows:
A portion of an alley in the original survey to the City of Jonesboro, Arkansas, and described as follows: Begin at the Southwest Corner of Lot 6, Block D; thence North approximately 90 feet to the Northwest Corner of Lot 4, Block D; thence West approximately 10 feet to the northeast corner of lot 7 of block d; thence south approximately 90 feet to the Southeast Corner of Lot 7, Block D; thence East approximately 10 feet to the Southwest Corner of Lot 6 of Block D, the point of beginning proper, all in the original survey to the City of Jonesboro, Arkansas; And
WHEREAS, after due notice as required by law, the council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley or the portion thereof, hereinbefore described, has heretofore been dedicated to the public use as an alley herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all owners of the property abutting upon the portion of the alley to be vacated have filed with the council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such alley.
SECTION 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, in and to a portion of an alley designated as follows:
A portion of an alley in the original survey to the City of Jonesboro, Arkansas, and described as follows: Begin at the Southwest Corner of Lot 6, Block D; thence North approximately 90 feet to the Northwest Corner of Lot 4, Block D; thence West approximately 10 feet to the Northeast Corner of Lot 7 of Block D; thence South approximately 90 feet to the Southeast Corner of Lot 7, Block D; thence East approximately 10 feet to the Southwest Corner of Lot 6 of Block D, the point of beginning proper, all in the original survey to the City of Jonesboro, Arkansas;
And herewith designate the above described portion of an alley legally closed and the property in fee simple title abandoned to the respective property owners of the adjoining property as they are designated on the petition to close alley.
SECTION 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the county and recorded in the deed records of the county.
SECTION 3: This Ordinance shall take effect and be in force from and after its passage and approval.
