AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING THE ZONING FOR THE ANNEXED LANDS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES:

WHEREAS, a petition for the annexation of a particular tract(s) to the City of Jonesboro, Arkansas , hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on August 2, 1991; and
WHEREAS, said petition for the annexation of these lands was duly signed by the owners of the tracts to be annexed to the City of Jonesboro, Arkansas; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held on September 4, 1991, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty (30) days having expired since the order of annexation dated September 4, 1991, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order dated October 6, 1991;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: All of the territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order dated September 4, 1991, be, and they are hereby accepted by the City of Jonesboro, Arkansas, and said territories hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: Description - Tract 1: ( Cindy Mey- Nash and Caraway) A part of the SW 1/4, NW 1/4 of Section 16, T13N, R4E, being more particularly described as follows: Begin at the Northwest corner of the NW 1/4 of Section 16 aforesaid; thence South along the West line of the NW 1/4 aforesaid, 1963.6 feet; thence North 88º25'30" East 215.74 feet to the point of beginning proper; thence continue North 88º25' 30" East 215.51 feet; thence South 404.25 feet; thence South 88º25' 30" West 215.51 feet; thence North 404.25 feet to the point of beginning proper, containing 2.0 acres, and being subject to a 25 foot road easement along the North side of the tract. Description - Tract 2: A part of the SW 1/4, NW 1/4 of Section 16, T13N, R4E, more particularly described as follows: Beginning at the Northwest Corner of said Section 16; thence South 1963.6 feet along the west line of said Section 16; thence North 88º 25'30" East 431.25 feet to the point of beginning proper; thence continue North 88º25'30" East 138.0 feet; thence South 404.25 feet; thence South 88º25' 30" West 138.0 feet; thence North 404.25 feet to the point of beginning proper, containing 1.28 acres, and being subject to a 25 foot road easement along the North side of the tract.
SECTION 3: The lands and territory annexed to the City of Jonesboro, Arkansas, and hereby accepted by the City of Jonesboro, Arkansas, are assigned and attached to Ward 5.
SECTION 4: Said lands and territory annexed to the City of Jonesboro, Arkansas, are hereby classified for the purpose of zoning as Residential One (R-1).
SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory, there-fore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
