AN ORDINANCE TO AMEND ARTICLE 2 OF SECTION 8: THE SAME BEING LICENSING OF ELECTRICIANS, CONTRACTORS, ETC.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: Section 8-16 of the Code of Ordinances of the City of Jonesboro, Arkansas is hereby amended to read as follows: All licensed Electrical Contractors shall report to the City Electrical Inspector the name, address and phone number of all licensed electricians and registered apprentices employed by them. Any licensed Electrical Contractors, failing to comply with this provision may be suspended. The reporting of the above information is to be done before January 31st of each year and within thirty (30) days of the employment of any new electrician or apprentice.

 

Section 2: Section 8-17 of the Code of Ordinances of the City of Jonesboro, Arkansas is hereby amended to read as follows Only Master electrician licensed by the City of Jonesboro or holding a current State of Arkansas Master electrician license will be permitted to obtain a privilege license and /or permitted to do electric work in the jurisdiction of the City of Jonesboro. No Master electrician or electrical contractor shall permit any person other than his employees to work under his license and/or permits.

 

Section 3: Section 8-19 of the Code of Ordinances of the City of Jonesboro, Arkansas is hereby amended to read as follows: The Board may revoke or cancel any certificate of competency issued by the Board for any violation or non-compliance with any other Ordinances of the City of Jonesboro, Arkansas or the rules and regulations of the Board or on account of incompetence of the person holding the certificate. A Certificate of Competency may be revoked if the person does not pay his license fee during the current calendar year of his privilege license for the current calendar year. If his license fee or privilege license has not been paid he will be required to either take a new state license examination or pay all delinquent fees, taxes and penalties before engaging in electrical work within the City of Jonesboro, Arkansas.

 

Section 4: Section 8-21 of the code of Ordinance of the City of Jonesboro, Arkansas is hereby amended to read as follows: It is hereby created the Jonesboro Electrical Board which will hereafter be referred to as “BOARD”. Said BOARD shall be composed of five (5) members, one of whom shall be a reputable person engaged in the business of insurance adjusting, two (2) electrical contractors who are master electricians, the manager of the City Water & Light Plant or someone of his start designated by said manager, the Mayor or some member of the City Council appointed by the Mayor with the approval of the Council. Appointments to the BOARD shall be made by the Mayor with the approval of the City Council upon the first Council meeting in January of each year. Members of the BOARD shall serve for a term of two (2) years. In case of a vacancy upon such BOARD the Mayor shall appoint, with the approval of the Council, some person to serve out the unexpired term of the member causing the vacancy.

 

Section 5: Section 8-22 of the Code of Ordinances of the City of Jonesboro, Arkansas is hereby amended to read as follows: The BOARD shall elect a chairman and secretary. The latter shall keep a full and complete record of the proceedings of the BOARD. The electrical inspector shall be authorized to keep a record of the names, addresses and telephone numbers of persons engaged in the electrical business in the City of Jonesboro, Arkansas and a list of master electricians, journeyman electricians, electrical maintenance men and apprentices working within the City of Jonesboro, Arkansas. The electrical inspector shall also keep a list of electricians that are current in payment of their registration fee as provided in Section 8-25 of the Code of Ordinances. A majority of the BOARD shall constitute a quorum.

 

Section 6: Section 8-25 of the Code of Ordinances of the City of Jonesboro, Arkansas is hereby amended to read as follows: Every person desiring to engage in any kind of electrical work or business within the City of Jonesboro, Arkansas, shall before engaging in such business have a valid license from the Arkansas State Electrical Board or hold an existing license issued by the Jonesboro Electrical Board.

 

The renewal fees for those electricians holding a license from the City of Jonesboro are as follows: Master electrician license, $10.00 per years; Journeyman electrician license, $5.00 per year; Electrical Maintenance Man license, $5.00 per year. There is no fee for an apprentice.

 

There will be a registration fee to be paid by all licensed electrician as defined above who are operating within the City of Jonesboro, Arkansas, in the amount of $10.00 to be paid at the time said electrician obtains the electrical permit.

 

The registration fee shall be an annual registration fee to be collected by the City Electrical Inspector and the necessary forms for registering all Master electricians, Journeyman electricians, Maintenance Men and Apprentice electricians shall be provide by the Electrical Inspector.

 

The Electrical Inspector shall issue a care to all Master electricians, Journeymen electricians, Electric Maintenance Men upon the payment of the above registration fee. The registration card shall not be issued until all applicable privilege taxes have been paid and where applicable all renewal fees have been paid.

 

The card must be carried by the electrician while working on a construction job or jobs and must be shown to the Electrical Inspector, Building Inspector or their authorized agents upon their request. Any person not holding a current license and registration card and performing electrical work within the City of Jonesboro, Arkansas will be required to halt said work immediately until they present to the City Electrical Inspector, Building Inspector or their authorized agents evidence of a current electrical license and registration card.

 

Section 7:  The following Sections are hereby repealed in their entirety. Section 8-26 and Section 8-26.1.

 

Section 8: All other sections, phrases, clauses, sentences and provisions contained in Article 2 of Chapter 8, not herein specifically amended or repealed, shall remain in their present form and stay in full force and effect.

 

Section 9: The sub-sections, phrases, sentences, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or sub-section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, that unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs or sub-sections of this Ordinance since they would have been enacted without the incorporation in this Ordinance of the unconstitutional phrase, clause, sentence, paragraph or sub-section.

 

Section 10: In the event any provision of this Ordinance shall be violated by any person, firm, association or a corporation, and the Electrical Inspector, Building Inspector or authorized agent issues an order to cease work and said person, firm, association or corporation fails or refuses to obey said order, that person, firm, association or corporation, shall be deemed quality of a misdemeanor and shall be subject to a fine not to exceed $500.00 per violation and each day said violation continues shall constitute a separate offense. In addition, to such criminal penalties as are stated above, the City of Jonesboro, Arkansas, shall have the immediate right to enjoy said person, firm, association or corporation from proceeding further on any job of jobs being carried on by said person, firm, association or a corporation.

 

Section 11: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of said conflict.

 

Section 12: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that to insure qualified competent electricians to service the needs of the citizens of Jonesboro, Arkansas, Article 2 of Section 8 required amendment and due to the fact that the State of Arkansas has instituted a state wide licensing procedure there is no need to establish separate licensing requirements by the City of Jonesboro, Arkansas. Therefore, an emergency is hereby declared to exist and this Ordinance shall take effect and be in full force from and after its passage and approval.
