MEMBERS PRESENT: Coleman, Little, Damron, McCracken, Finley, Beadles, Pitts, Shaw and Phillips

 

MEMBERS ABSENT: None

 

Minutes of the October 11, 1994, meeting were approved as submitted.

 

#1 SU94-18 Michael Blalock requested approval of placement of a mobile home at 1305 Mays Road.

 

A motion was made by Ms. Shaw, and seconded by Mr. Damron to approve the request. Five voted aye, 0 no, 3 absent for vote, REQUEST APPROVED.

 

#2 RZ94-35 Gus and Marcel Fallis request approval of rezoning from Residential R-1 to Commercial C-3 for 2.5 acres located on the northwest corner of Willow Road and

Access Road.

 

Mr. McCracken made a motion to approve the request subject to:

 

1.                     Acknowledgment from property owner to agree to do a general clean up of property he owns in the area.

2.                     Willow Road right of way adjoining this property be shown on plat, no less than 40’ from centerline.

3.                     Site plan must be presented prior to development.

4.                     Existing sewer easement must be shown on plat.

 

Mr. Pitts seconded, 7 voting aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATIONS.

 

#3 RZ94-36 Bob Hansen requested approval of rezoning from Commercial C-3 to Industrial I-1 for .82 acres located on the northwest corner of Southwest Drive and Oak Park Drive.

 

After a long discussion on right of way and ownership of a ditch between property and street, Mr. McCracken made a motion to deny the request. With no I-1 zoning existing for several miles and with none anticipated, there is no justification for this zoning on a lot this small. Ms. Finley seconded the motion 7 voted aye, 0 no, one absent for vote. REQUEST DENIED.

 

#4 RP94-59 Bob Hansen requested approval of a two lot replat located on the northwest corner of Southwest Drive and Oak Park Drive.

 

Mr. McCracken made a motion to table the request as the owner’s representative does not know whether the owner wishes to replat the property if the rezoning failed. Other issues that need to be clarified are right of ways, location of ditches, road placement, access to Oak Park and a street improvement agreement for Oak Park Drive. Ms. Shaw seconded the motion, 7 voted aye, 0 no, one absent for vote, REQUEST TABLED.

 

#5 RZ94-37 David Gary requested approval of rezoning from R-3 to C-3 for Lots 1, 2, & 3, Block C and Lots 1, 3, 33 & 23, Block D of Fairview Acres Subdivision. The property is located on the east side of Stadium Blvd., north of Race Street and south of Fairview Drive.

 

Mr. Phillips made a motion to approve the request with the following stipulations:

 

1.                     Owner’s signature verification.

2.                     Site plan submitted before development.

3.                     Address street improvements, buffers, fencing, etc., on the site plan.

 

Ms. Finley seconded, 7 voted aye, 0 no, one absent for vote, REQUEST APPROVED WITH STIPULATIONS.

 

#6 RP94-60 David Gary requests approval of a replat of Lots 1, 2 & 3 of Block C and Lots 1, 2, 33 & 23 of Block D of Fairview Acres Subdivision. The property is located on the east side of Stadium Blvd., north of Race Street and south of Fairview Drive.

 

In discussion with the representative for the property owners, Commissioners stated when this comes back for a site plan, fencing and street improvements are to be addressed.

 

Mr. Pitts made a motion to approve the request with the following stipulations:

 

1.                     Show 60’ centerline on Lot 1, Stadium Blvd.

2.                     Show 50’ centerline on Race Street.

 

Ms. Shaw seconded the motion, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#7 FP94-20 Delta-Coleman, Inc. and Paul Throgmartin request final approval of subdivision plans for Throgmartin Estates Phase I containing 10 lots on 4.35 acres. The property is located on the north side of Prospect Road, east of Paragould Drive.

 

Mr. McCracken made a motion to approve the request subject to:

 

1.                     Engineer’s comments regarding drop inlets on Elizabeth, swapping out type of pipe.

2.                     Ditches to remain open during construction.

3.                     Ditch section to be shown.

4.                     Right of way and street improvements being made to north property line.

5.                     Notation on plat that adjoining property right of way should be shown for future development.

 

Ms. Shaw seconded, 8 voting aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#8 PP94-20 Todd Jackson requested preliminary approval of subdivision plans for Lexington Estates containing 34 lots on 9.02 acres. The property is located on the east side of Wood Street, south of Plantation Oaks.

 

Mr. Pitts made a motion to approve the preliminary plat subject to the following:

 

1.                     Engineer’s comment contained in the staff report.

2.                     Addressing erosion control during construction.

3.                     Causing no undue drainage hardships downstream.

 

Ms. Shaw seconded, 8 voted aye, 0 no, REQUEST APPROVED WITH STIPULATIONS.

 

#9 PUD94-3 James Darnell requested approval of revised Planned Unit Development plans for a part of Country Meadow Addition. The property is located on the north side of Auburn Plane, east of Hester Street.

 

Mr. McCracken made a motion to deny the request based on:

 

1.                     Parking requirements not being met.

2.                     Driveways not being 24’ wide.

3.                     Floodway designation not being correct.

4.                     Property dispute on north line.

5.                     Building over drainage pipe.

 

Mr. Phillips seconded the motion, 8 voted aye, 0 no. REQUEST DENIED.
