AN ORDINANCE TO CONDEMN A HOME LOCATED AT 1720 ARCH STREET; TO IMPOSE A LIEN UPON SAID PROPERTY AND TO REMOVE SUCH STRUCTURE FROM SAID PROPERTY AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: Mrs. Paul Hanshaw is the owner of the following described property and that said owner is hereby ordered to remove or raze the building upon said property within thirty (30) days from the effective date of this Ordinance.

 

Section 2: That said property is hereinafter set forth in this Section, giving the street address and the hazard which it constitutes to the citizens of Jonesboro, Arkansas, the same being as follows: The property is located at 1720 Arch Street, Jonesboro, Arkansas, and said structure is deficient as follows: The kitchen sink lavatory, tub and water closet are not maintained in good sanitary working condition, these fixtures are considered unsanitary and dilapidated; the electrical wiring throughout the structure is deteriorated and needs replacement; the foundation needs extensive repair and is not supporting the floors which are swayed; exterior walls are not maintained and in sound condition and good repair; the roof is completely missing on portions of the North half of the structure; windows and doors are not substantially weather tight, water tight and rodent proof and are not maintained in sound working condition and good repair; hardware on doors and windows need repair or replacement; exterior doors need repair and adjustments to eliminate wind and rain from entering the structure; structure needs painting after exterior walls are repaired; interior floors are buckled or uneven and need extensive repair; walls and ceilings need major repair throughout the structure; structural supports are questionable due to deterioration and age, repair is needed.

 

Section 3: The City Attorney is hereby directed to institute such legal proceedings, as may be necessary, in order to enforce the provisions of this Ordinance and to remedy the dangers and unsightly conditions brought about as a result of the failure of the owner to property keep up said property.

 

Section 4: That said legal proceedings shall provide that unless the house is razed within a certain period to be allowed by the Court, the City of Jonesboro, Arkansas, is hereby authorized to raze said property and have a lien upon the real estate for the cost of removing said house.

 

Section 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of said conflict.

 

Section 6: The City Council finds and declares that the structure owned by Mrs. Paul Hanshaw is in such a dilapidated and hazardous condition as to constitute a fire and health hazard to the citizens and residents, whose property adjoin the property in question and that this Ordinance needs to be put into effect immediately to protect the public peace, health and safety of the citizens of Jonesboro, Arkansas and therefore an emergency is hereby declared to exist and this ordinance shall be in full force from and after its passage and approval.
