The minutes of the November 3, 1989, November 14, 1989 and November 28, 1989 were approved as prepared.

 

#1 RZ89-47 Dale Trammel request rezoning from R-1 to C-3 for 2.032 acres located on a part of the NE ¼, NW ¼, of Section 9, T13N and R4E. The property is located on the west side of Arkansas Hwy. 163 Spur, north of the Missouri Pacific Railroad and east of Arkansas Hwy.1.

 

Mr. Vance made a motion to approve this request subjects to a site development plan being approved by the MAPC before a building permit is issued. Mr. Aycock seconded the motion. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#2 RZ90-48 Mitt Songer requested rezoning from R-1 to R-2 for one (1) acre located on a part of the NE ¼ of Section 23, T14N and R3E. The property is located on the east side of Loberg Lane, south of Matthews Avenue.

 

Mr. Patteson made a motion to approve this request with the stipulations that:

 

1.                     The, owner provide street improvements now, namely widening the installation of curb and gutter, on Loberg Lane where it adjoins this property.

2.                     The site development plan be approved by the Building Inspector and the City Engineer.

3.                     The road easement on the plat be changed to street right-of-way.

 

The motion was seconded by Mr. Vance. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#3 RZ89-49 & RP89-48 Ruben Griffin requested rezoning from R-2 to C-1 for Lots 1, 2, 3 & 4 of Pardew Addition and a replat of Lots 1, 2, 3 & 4 of Pardew Addition and Lots 13, 14, 15 & 16 of Howard’s Addition to Nettleton, AR. The property is located on the north side of Nettleton Avenue, west of Watt Street and south of Frisco Street.

 

A motion to approve the rezoning was made by Mr. Vance subject to the owner signing an agreement to provide street improvements on Watt Street and Frisco Street when improved by the City. The motion was seconded by Mr. Blalock. Voting was 6 in favor, 0 opposed. REZONING REQUEST APPROVED WITH STIPULATIONS.

 

Mr. Sloan made a motion to approve the replat request with the statement that the owner should take note that this replat puts the building on Lot 2 into the street right-of-way and is therefore nonconforming and the gas pumps are too close to the street right-of-way and therefore they are nonconforming. The motion was seconded by Mr. Patteson. Voting was 6 in favor, 0 opposed. REPLAT REQUEST APPROVED.

 

#4 RZ89-50 Floyd Wineland requested rezoning from R-1 to C-3 for 3.06 acres located on a part of the SE ¼, SE ¼, of Section 25, T14N and R3E. The property is located on the south side of Arkansas Hwy. 63 Bypass, east of Hwy. 49.

 

A motion to approve this request was made by Mr. Vance subject to the right-of-way for the Bypass frontage road being shown on the plat. Mr. Blalock seconded the motion. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#5 AZ89-7 R, R & G Corporation request approval of annexation and zoning classification of R-1 for a part of the south half of Section 12, T13N and R3E (known as Southview Acres). The property is located on the south side of Lawson Road, approximately ½ mile west of S. Culberhouse.

 

Mr. Vance made a motion to approve this request subject to:

 

1.                     The right-of-ways being shown on all streets.

2.                     Utility easements being granted, 7.5’ either side of the property lines between Lots 17 & 18 and Lots 12 & 13, and with the statement, that the streets are being taken in “as is” and will be maintained “as is”.

 

The motion was seconded by Mr. Aycock. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#6 RP89-41 Future Homes Development Company request for a replat of Lots 18 and 19 of Farm Creek Homesites Second Addition was approved by a motion by Mr. Vance and a second by Mr. Patteson. The property is located on the west side of Win Brook Circle. Voting was 5 in favor, 0 opposed. REQUEST APPROVED.

 

#7 RP89-42 A request by David Wright and Steve Baker to replat Lots 8 and 9 of the Replat of Lots 1-9, 17 and 19-21 of Merrywood Subdivision was approved by a motion by Mr. Coleman and a second by Mr. Patteson. The property is located on the east side of Metzler Lane, north of Merrywood Drive. Voting was 5 in favor, 0 opposed. REQUEST APPROVED.

 

#8 RP89-43 Kent Arnold requested a replat of Lot 7, Block B and Lot 1, Block C of Caraway Place Phase I. The property is located south of Glenn Place, on the east and west sides of Kent’s Place.

 

Mr. Vance made a motion to approve this request subject to the 20’ drainage easement on the south side of Lot 7 being changed to 20’ drainage and sewer easement. The motion was seconded by Mr. Coleman. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#9 RP89-44 Wayne Baker requested a replat of Lot 13B and part of Lot 12, Block 8 of Ridgecrest Addition and part of Lots 10-13 Block D of Belmont Addition into Lot 1 of Wayne Baker’s Subdivision. The property is located northwest of Southwest Drive at the dead end of Concord Street.

 

A motion to approve this request was made by Mr. Coleman subject to the utility easement being worked out with the appropriate utility. Mr. Vance seconded the motion. REQUEST APPROVED WITH STIPULATIONS.

 

#10 RP89-45 Jim Mashburn requested a replat of Lots 12 and 13 of McDaniel Subdivision, Third Addition. The property is located at the north end of Park Hill Blvd., off Neely Road.

 

A motion to approve this request was made by Mr. Patteson subject to the utility easement being worked out with the appropriate utility easement being worked out with the appropriate utility with the easement not to exceed 10’. Mr. Coleman seconded the motion. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#11 RP89-46 Lee Taylor requested a replat of Lots 27, 28, 29 and 30R of North Belgrath Heights subdivision. The property is located on the east side of Royale Drive, south of Hwy. 63B.

 

A motion to approve this request was made by Mr. Vance subject to the owner signing an agreement to provide street improvements on Royale Drive when improved by the City. The motion was seconded by Mr. Aycock. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#12 RP89-47 Randy and Shannon Caples requested a replat of Lots 4 and 5, Block A of Mays Addition into Lot 4, Block A of Mays Addition. The property is located west of Mays Road, off Greensboro Rd.

 

A motion to approve this request was made by Mr. Aycock subject to the owner signing an agreement to provide street improvements on Mays Road when improved by the City. The motion was seconded by Mr. Vance. Voting was 5 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.
