AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF JONESBORO, ARKANSAS: ANNEXING SAID TERRITORY TO WARD 4: DECLARING AN EMERGENCY: AND FOR OTHER PURPOSES

WHEREAS, the City of Jonesboro, Arkansas desires to annex certain lands to the City of Jonesboro, Arkansas, hereinafter described; and

 

WHEREAS, said lands are completely surrounded by lands incorporated into the City of Jonesboro: and

 

WHEREAS, the City of Jonesboro has held a public hearing within 60 days of the proposal of this ordinance at which hearing individuals were allowed to appear and present their views on the proposed annexation; and

 

WHEREAS, the City of Jonesboro published a legal notice setting out a legal description of the territory proposed to be annexed at least 15 days prior to the date of said public hearing; and

 

WHEREAS, the City of Jonesboro did notify by certified mail all the property owners within the area proposed to be annexed of their right to appear at the public hearing to present their views on the proposed annexation; and

 

WHEREAS, the City of Jonesboro intends to extend police and fire protection, garbage pickup and street maintenance into the said territory; and

 

WHEREAS, the said territory to be annexed, complies with the standards for lands qualifying for annexation which are set forth in Section 1 of Act 298 of 1971, as amended.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands hereinafter described are accepted and annexed by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows: (Island off Wood Springs Road in Southwest Jonesboro - Don Culpepper)

 

TRACT 1: A part of the Northeast Quarter of the Northwest Quarter of Section 25, Township 14 North, Range 3 East, more particularly described as follows: Beginning at the Northeast Corner of the Northeast Quarter of the Northwest Quarter; thence North 89°46’ West 325 feet to the point of beginning; thence North 89°46’ West 325 feet; thence South 1°49’ West, 450 feet; thence East 0°14’ South, 325 feet; thence North 1°49’ East, 37.8 feet; thence West 3°48’ North, 210 feet; thence North 1°49’ East, 210 feet; then East 3°48’ South, 210 feet; thence North 1°49 East, 202.2 feet to the pint of beginning proper. Less and except that part across the South portion thereof that is subject to road right-of-way for Wood Springs Road.

 

TRACT 2: A part of the Northeast Quarter of the Northwest Quarter of Section 25, Township 14 North, Range 3 East, more particularly described as follows: Begin at the Northeast Corner of the Northeast Quarter of the Northwest Quarter of said Section 25; thence North 89°46’ West 325 feet; thence South 1°49’ West 202.2 feet to the point of beginning proper; thence continue South 1°49’ West 210 feet to the North right-of-way line of Wood Springs Road, thence North 87°12’ West along said right-of-way 210 feet; thence North 1°49’ East 210 feet; thence South 87°12’ East 210 feet to the point of beginning proper, containing 1.01 Acres, more-or-less.

 

TRACT 3: A part of the Northeast Quarter of the Northwest Quarter of Section 25, Township 14 North, Range 3 East, more particularly described as follows: Beginning at the Northeast corner of the Northeast Quarter of the Northwest Quarter of said Section 25: thence North 89°46’ West 162.5 feet to the point of beginning proper; thence continue North 89°46’West 162.5 feet; thence South 1° 49’ East 450 feet; thence East 162.5 feet; thence North 1°49’ West 450 feet to point of beginning proper, subject of Road Right-of-way on the South side thereof.

 

TRACT 4: A part of the Northeast Quarter of the Northwest Quarter of Section 25, Township 14 North, Range 3 East, more particularly described as follows: Begin at the Northeast Corner of the Northeast Quarter of the Northwest Quarter; thence North 89°46’ West, 162.5 feet; thence South 1°49’West, 450 feet; thence East 0°14’ South, 162.5 feet; thence North 1°49’ East, 450 feet; to the point of beginning proper, less and except that part across the Southwest Corner thereof which is subject to road right-of-way for Wood Springs Road.

 

TRACT 5: All that part of the Northwest Quarter of the Northeast Quarter of the Northwest Quarter of Section 25, Township 14 North, Range 3 East which lies East of the West bank of Christian Creek Ditch and North of Wood Springs Road.

 

Section 3: The lands and territory annexed to the City of Jonesboro are hereby annexed by the City of Jonesboro and are accepted by the City of Jonesboro and assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-1) for Tracts 1, 2, 3 & 4, and Commercial (C-4) for Tract 5.

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro that there is an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and citizens and property owners of the said territory can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protections are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.

 

PASSED and ADOPTED this 21st day of October, 1985.
