AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORIES TO WARD 5; ZONING SAID TRACT 1 RESIDENTIAL (R-2) AND ZONING SAID TRACT 2 RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, petitions for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, were duly filed in the County Court of Craighead, County, Arkansas, on February 27, 1986, and May 30, 1986,; and
WHEREAS, said petitions for the annexation of said lands where duly signed by the sole owners of all the acreage to be annexed to the City of Jonesboro; and
WHEREAS, orders setting hearings upon said petitions were entered, notices were duly published of said hearings and hearings upon said petitions were duly had and held in the County Court of Craighead County, Arkansas, on March 19, 1986, and September 10, 1986, at which hearings it was duly found and declared that said petitions for annexation were right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon orders of annexation were made and entered; and
WHEREAS, thirty (30) days have expired since the orders of annexation dated March 19, 1986, and September 10, 1986, and no proceedings to prevent said annexations have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its orders of May 2, 1986, and October 10, 1986.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territories and lands annexed to the City of Jonesboro by orders of the County Court of Craighead County, Arkansas, by its orders of March 19, 1986, and September 10, 1986, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territories hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, more particularly described as follows: (Tract 1 David Ferguson, Craighills Golf Course, Craighead Forest Rd. and Tract 2 Burl and Loretta Brooks, Hwy. 1 S., adjacent to Craighills Gold Course - Ray Nickle)
TRACT 1: The South 100 acres of equal width of the Northwest Quarter of Section 5. Township 13 North, Range 4 East, excepting a rectangular strip off the entire West side thereof containing 16 acres, and also excepting a rectangular strip off the East side thereof containing 4 acres; the tract contains approximately 80 acres, more or less.
TRACT 2: Part of the Southeast Quarter of the Northwest Quarter and part of the Southwest Quarter of the Northeast Quarter of Section 5, Township 13 North, Range 4 East, which is described as follows: commence at the Southwest corner of the Southwest Quarter of the Northeast Quarter of Section 5 aforesaid, thence North to the North line of a county road approximately 30 feet to the point of beginning proper, thence run East along the North right-of-way line of the county road approximately 229.4 feet to the West line of State Highway No. 1, thence run North a distance of 738.8 feet along the West right-of-way line of State Highway No.1, thence run West parallel to the Southern boundary of this property a distance of approximately 352 feet to the Eastern edge of the Craighills Golf Course, thence run South parallel to the quarter section line to a point which is 200 feet from the centerline of the county road, thence South to the point of beginning proper which contains 6.89 acres more or less.
Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas
Section 4: Said lands and territories annexed to the City of Jonesboro and hereby zoned:
Tract 1: Residential (R-2)
Tract 2: Residential (R-2)
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territories herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territories described herein can be entitled to fire, police, zoning, water and sewage and other protection and benefits. Said protection and benefits are urgently needed now in order to allow orderly growth and development of said lands and territories. Therefore, an emergency is herby declared to exist, this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.
