AN ORDINANCE TO AMEND CHAPTER 117, ARTICLE III, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS, PROVIDING FOR A CHANGE IN ZONING BOUNDARIES FROM R-1 SINGLE FAMILY MODERATE INTENSITY DISTRICT TO RM-12 MULTI FAMILY RESIDENTIAL DISTRICT FOR PROPERTY LOCATED AT 300 E PINE STREET, JONESBORO, ARKANSAS, AS REQUESTED BY CARRINGTON MOREHOUSE

WHEREAS, the owners of certain real property located at 300 E. Pine Street, Jonesboro, Arkansas, have filed a request to rezone said property from R-1 Single Family Moderate Intensity District to RM-12 Multi Family Residential District; and
WHEREAS, the Metropolitan Area Planning Commission has reviewed said request and, after due consideration, has recommended approval of the proposed rezoning; and
WHEREAS, the proposed rezoning with conditions is deemed appropriate for the orderly growth and development of the City; and
WHEREAS, the City Council finds that the requested zoning change promotes the public health, safety, and welfare of the citizens of Jonesboro;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION 1. Chapter 117, Article III of the Code of Ordinances of the City of Jonesboro, Arkansas, be amended so as to change the zoning classification of the following described property:
FROM: R-1 Single Family Moderate Intensity District
TO: RM-12 Multi Family Residential District
For the following described property:
That part of Block 13 R.L. Hayes Second Addition to the City of Jonesboro, Arkansas, being more particularly described as follows: Beginning at a 2" pipe marking the Northwest corner of said Block 13; run thence N89°25 'E 134.4 feet (134.7 feet measured) to a found rebar; run thence S1°00’W 162.1 feet to a found pipe; run thence S89°28’W 134.2 feet; run thence N0°55'E 161.9 feet to the true point of beginning, containing 0.50 acre, more or less.
The South 208.9 feet of Block 13 of R.L. Hayes Second Addition to the City of Jonesboro, Arkansas. Together with any rights of the alley adjacent to the West side thereof.
All of Block 14 of R.L. Hayes Second Addition to the City of Jonesboro, Arkansas. Together with any rights of the alley adjacent to the West side thereof.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 3. The rezoning of this property shall adhere to the following conditions:
1. That the proposed site plan shall satisfy all requirements of the City Engineer, all requirements of the current Stormwater Drainage Design Manual and Flood Plain Regulations regarding any new construction.
2. A final site plan subject to all ordinance requirements shall be submitted, reviewed and approved by the Planning Department prior to any redevelopment of the property.
3. Any change of use shall be subject to Planning Commission approval in the future.
4. The sight shall comply with all overlay district standards.
