AN ORDINANCE SUBMITTING TO THE VOTERS OF THE CITY OF JONESBORO, ARKANSAS, AND OTHER AFFECTED PERSONS THE QUESTIONS OF ANNEXATION TO SAID CITY OF JONESBORO CERTAIN CONTIGUOUS TERRITORY.

WHEREAS, it appears to the Council of the City of Jonesboro, Arkansas, that certain hereinafter described territory contiguous to the said City of Jonesboro is necessary for the orderly growth of said City; and

 

WHEREAS, the lands are platted and held for sale or use as municipal lots or whether platted or not, the lands are held to be sold as suburban property; and

 

WHEREAS, the lands furnish the abode for a densely settled community or represent the actual growth of the municipality beyond its legal boundary; and

 

WHEREAS, the lands are needed for proper municipal purposes; and

 

WHEREAS, the lands are valuable by reason of their adaptability for prospective municipal uses.

 

THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:    

 

SECTION 1: That there shall be submitted to the qualified electors of the City of Jonesboro and of the following described area lying in Craighead County, Arkansas, the question of the annexation of the below described territory to the City of Jonesboro, Arkansas.  The area included in the following description not currently in the City of Jonesboro, Arkansas

 

TOWNSHIP 15 NORTH, RANGE 3 EAST

The East Half of the Southeast Quarter; and the Southeast Quarter of the Northeast Quarter,  all  in  Section 36,  Township 15  North,  Range 3  East  of  the  5th  Principal Meridian in Craighead County,  Arkansas,  along with all subdivisions or parts thereof contained there in as recorded in the office of the Circuit Clerk of the Western District of Craighead County, AND:

 

TOWNSHIP 15 NORTH, RANGE 4 EAST

All of the South Half; and all of the South Half of the Northwest Quarter; and all of the South Half of the Northeast Quarter, all in Section 31; and all of the South Half of Section 32; and the South 300 feet of Section 34; and the South 300 feet of the Southwest Quarter of the Southwest Quarter of Section 35; all in Township 15 North, Range 4  East of the 5th  Principal  Median  in  Craighead County,  Arkansas, along with all subdivisions or parts thereof contained therein as recorded in the office of the Circuit Clerk  of  the  Western  District  of  Craighead  County  and;

 

TOWNSHIP 14 NORTH, RANGE 3 EAST

All of Sections 1, 12, 13, 14, 15, 22, 23, 24, 25, 26, 27, 34, 35 and 36; and that part of Section 2 and that part of Section 11 lying East of the Bid Creek Ditch; and that part of Section 9 lying South of a line 300 feet North of and parallel to the North right-of-way of US Highway 63 Business Route and 300 feet North of and parallel to the North right-of-way of Arkansas Highway 18 and lying North of a line 300 feet South of and parallel to the South right-of-way of  US Highway 63 Bypass; and  that part of  Section 10 lying South of a line 300 feet North of and parallel to the North right-of-way of US Highway 63 Business Route; and  further that  part of the  East Half of  the Southeast  Quarter of Section 10 lying East of the center of Big Creek Ditch; and all of the East Half of Section 33;  all in Township 14 North,  Range 3 East of  the 5th Principal Meridian  in Craighead County, Arkansas,  along  with  all  subdivisions  or  parts  thereof contained  therein  as recorded  in  the office of  the Circuit Clerk of the Western District of Craighead County, and;

 

TOWNSHIP 14 NORTH, RANGE 4 EAST

All of sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 23, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35 and 36; and  all of  the South Half of  the  Southeast Quarter; and  all  of  the  South Half of the Southwest Quarter, and that part of the North Half of  the  Southwest Quarter lying South of  the centerline of Lateral Number One to Little Bay Ditch in Section 13, all in Township 14 North, Range 4 East of the 5th Principal Meridian  in  Craighead  County,  Arkansas, along  with all subdivisions or parts thereof contained therein as recorded in the office of the Circuit Clerk of the Western District of Craighead County, AND;

SECTION 2: The question of annexation of the territory described above in Section 1 shall be submitted to the electors qualified to vote on this issue at a General Election to be held on November 8, 1988.  The City Clerk shall immediately notify the County Election Commission by forwarding a certified copy of this ordinance.

 

SECTION 3: If at such election a majority of the qualified electors voting in such election shall vote for such annexation, the municipality shall proceed to file a description and a map of the annexed area with the County Clerk of the county wherein the land lies and with the Secretary of State.  The annexation shall be included within the corporate limits of the annexation city thirty (30) days following the filing of the description and map with the County Clerk, or in the event an action is filed with the Circuit Court, on the date the judgment of said Court becomes final.

If a majority of the qualified electors voting on the issue at the election vote against the annexation, the annexation ordinance shall be null and void.

 

SECTION 4: If the annexation is approved and becomes final, the following services shall be extended to the area within three (3) years:  

 

Police Protection - 

Fire Protection -

Electric Service   

Sanitation Service (Garbage pick up)

 

SECTION 5: The ballots used at said election on the question of annexation shall be marked as

follows:

 

FOR annexation of the territory described in Ordinance No. 2137.

 

AGAINST annexation of the territory described in Ordinance No. 2137.

 

 

PASSED AND APPROVED this 6th day of September, 1988.
