AN ORDINANCE DISSOLVING FARM CREEK SUBDIVISION ROAD IMPROVEMENT DISTRICT NO. 5

WHEREAS, after proper notice, and hearing before the City Council of the City of Jonesboro, the Farm Creek Subdivision Road Improvement District No. 5 was established on August 2, 1993, by Ordinance No. 2492; and
WHEREAS, this improvement district was established for the purpose of improving the roadways within the city limits of the City of Jonesboro, Craighead County, Arkansas; and
WHEREAS, this improvement district included the following described property:
Lots 1 through 22 of Farm Creek Home Sites, Craighead County, Arkansas;
Lots 1 through 36 of Farm Creek Homes Sites Second Addition;
The Replat of Lots 18 and 19 of Farm Creek Home Sites Second Addition;
The Replat of Lots 26 and 27 of Farm Creek Homes Sites Second Addition; and
A part of the Southeast Quarter of the Southeast Quarter of Section 36, Township 14 North, Range 3 East, Craighead County, Arkansas, being more particularly described as follows, to wit: Begin at the Northeast Corner of the Southeast Quarter of the Southeast Quarter of said Section 36; thence South 89°23' West 244.38 feet on the 40 acre line to the point of beginning proper; thence South 208.71 feet; thence North 89°23' East 208.62 feet to the West right of way line of Culberhouse Road (Arkansas Highway No. 141); thence North 0°17'06" East 50.49 feet; thence North 0°1'23" East 158.22 feet; thence West along the 40 acre line to the point of beginning proper; and
WHEREAS, on September 20, 1993, the City of Jonesboro established by Ordinance No. 2510, the method for payment of the assessed benefits for Farm Creek Subdivision Road Improvement District No. 5; and
WHEREAS, all payments of the assessed benefits for Farm Creek Subdivision Road Improvement District No. 5 have been completed and paid in full;
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
SECTION 1: That the property owners involved herein have successfully completed payment of the assessed benefits for Farm Creek Subdivision Road Improvement District No. 5.
SECTION 2: That by this ordinance and the Jonesboro City Council the Farm Creek Subdivision Road Improvement District No. 5 is hereby dissolved.
SECTION 3: That any and all taxes collected which are not necessary for payment of the indebtedness or expenses for the Farm Creek Subdivision Road Improvement District No. 5 shall be repaid to the property owners who paid their taxes for 1997 during 1998.
