AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS: DATED JANUARY 20, 1976; ASSIGNING SAID ANNEXED TERRITORIES TO WARD 3: DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for annexation of certain lands to the City of Jonesboro, Arkansas herein after described, was duly filed in the County Court of Craighead County, Arkansas on December 19. 1975; and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas on January 20, 1976, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands herein after described should be annexed to the City of Jonesboro, Arkansas, whereupon order of annexation was made and entered, and

 

WHEREAS, thirty days have expired since the order of the annexation dated January 20, 1976, and no proceedings to prevent said annexation have been filed in the Circuit Court of the Jonesboro District to Craighead County, Arkansas, said annexation proceedings are, in all things, confirmed of the County Court of Craighead County, Arkansas, by its order of January 20, 1976.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of January 20, 1976, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

The part of the Northeast Quarter Section 17, Township 14 North, Range 4 East, described as follows: Begin at the North Quarter corner of Section 17, Township14 North, Range 4 East; thence East 1,430.6 feet; thence South 1 degree 28 minutes West 396.6 feet; thence South 88 degrees 55 minutes East 249.2 feet to a point of beginning proper. Thence South 88 degrees 55 minutes East 300 feet; thence South 1degree 28 minutes West 66 feet; thence South 1 degree 37 minutes West 114 feet; thence South 50degrees 53 minutes West 82.8 feet to a point on a 50 minutes radius curve; thence Northwesterly along said curve 60.2 feet; thence North 88 degrees 55 minutes West 184.7 feet; thence North 1 degree 05 minutes East 200 feet to the point of beginning proper, containing 1.389 acres.

 

Section 3: The lands and territory annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro, and are hereby assigned and attached to Ward 3 of the City of Jonesboro, Arkansas.

 

Section 4: The land and territories annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro, and are hereby classified for zoning proposes as Residential (R-2).

 

Section 5: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and residents of said territory described herein can be entitled to fire, police, zoning and other protection and benefits; that said benefits and protections are urgently needed now in order to allow growth and development of said land and territories. Therefore, and emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and shall be in full force from and after its passage and approval.
