WHEREAS, it has been determined that the City of Jonesboro's existing financial software is inadequate and that replacement software is desired and necessary; and
 
WHEREAS, Springbrook Software has been identified as the software which best meets the City's financial software requirements and is available from ProSoft Solutions; and
 
WHEREAS, provisions of A.C.A. 14-58-303 allow for the waiver of competitive bidding by the City's governing body in exceptional situations where bidding is not deemed feasible or practical; and
 
WHEREAS, the 2004 adopted City budget contains an appropriation of $50,000 toward the acquisition of financial software, which is insufficient to fund the purchase of Springbrook Software;
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: The purchase and implementation of Springbrook Software from ProSoft Solutions is approved for the sum of $230,100, such amount to include first-year maintenance fees.
 
SECTION 2: Replacement financial software is deemed necessary for effective financial management of the City; therefore, competitive bidding is waived in accordance with provisions of A.C.A. 14-58-303.
 
SECTION 3: The sum of $180,100 is appropriated from the General Fund unappropriated fund balance for the purchase of Springbrook Software to provide additional funding not included in the 2004 adopted City budget, and the sum of $13,856 is appropriated for sales tax on the purchase.
 
SECTION 4: Emergency Clause.   It is hereby found and determined that the purchase and implementation of replacement financial software is necessary for effective financial management of the City of Jonesboro.   Therefore, an emergency is declared to exist, and this ordinance shall become effective on the date of its passage and approval.
