AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MARCH 15, 1977

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on February 1, 1977: and

 

WHEREAS, said Petition for the annexation of said lands was signed by a majority of the real estate owners owning a majority of the acreage to be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, an Order setting a hearing upon said Petition was entered, Notice was duly published of said hearing and hearing upon said Petition was duly had and held in the County Court on March 15, 1977, at which hearing it was duly found and declared that said Petition for Annexation was right and proper and that such lands, hereinafter described, should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of the annexation was made and entered; and 

 

WHEREAS, thirty (30) days have expired since the Order of Annexation dated March 15, 1977, and no proceedings to prevent said annexation have been filed in the Circuit Court of Craighead County, Arkansas, and said annexation proceedings are in all things confirmed:

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City of Jonesboro, Arkansas:

 

Section 1: That the territory and lands annexed to the City of Jonesboro, Arkansas, by Order of the County Court of Craighead County, Arkansas, by its Order of March 15, 1977, be, and are hereby, accepted by the City of Jonesboro, Arkansas, and said territory, hereinafter described, shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Dalton Farmer property)

 

A part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 14 North, Range 4 East, being more particularly described as follows: Begin at the Northeast corner of the Northeast Quarter of the Southwest Quarter of Section 28, Township 14 North, Range 4 East; thence South 89 degrees 09 minutes West 331.54 feet to the point of beginning proper; thence South 89 degrees 09 minutes West 24.5 feet; thence South 1148.9 feet; thence North 89 degrees 08 minutes East 24.5 feet; thence North 1148.9 feet to the point of beginning proper; containing 0.65 acre, and subject to public road right-of-way across the North thereof.

 

Begin at the Northeast corner of the Northeast Quarter of the Southwest Quarter, Section 28, Township 14 North, Range 4 East; thence South 89 degrees 09 minutes West 331.54 feet; thence South 1148.9 feet; thence North 89 degrees 08 minutes East 331.54 feet; thence North 1148.8 feet to the point of beginning, containing 8.74 acres, and subject to public road right-of-way across the North and East thereof.

 

Section 3: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that the territory hereinabove described by annexed to and accepted by the City of Jonesboro, Arkansas, and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that the same be annexed to the City so that the territory that is set out above may be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow the growth and development of said land and territory. Therefore, this Ordinance, being necessary for the preservation and protection of the property, peace, health and safety, shall take effect and be in full force from and after the date of its passage.

 

Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that the territory hereinabove described be hereafter zoned Commercial (C-3) as the same has been found to be platted to conform to C3 requirements and developed accordingly.

 

PASSED and ADOPTED this 6th day of June, 1977.
