Minutes for the City Council meeting on May 15, 1995

APPEAL HEARING - 7:00 P.M. - An appeal hearing was held as requested by Ms. Linda Smallman and her attorney, Jim Lyons. Mr. Lyons stated the property in question was annexed in as Residential One but other Residential Two zonings (Kitterman property) were located near the Smallman property. Ms. Smallman was requesting Residential Two zoning for the purpose of building a duplex. Mr. David Blair, property owner south of the Smallman property, spoke in opposition to the rezoning, citing spot zoning has the reason. Mr. Blair stated the property had no sewer, but Ms. Smallman explained she could get access to sewer off Victoria Lane or Mary Ann Drive.

 

PUBLIC HEARING - 7:15 P.M. - A public hearing was conducted at the request of Mr. Harvey Newcom for the purpose of vacating an unimproved portion of East Street, located north of Cate Avenue, east of Church Street and west of Vandyne Street. No opposition was voiced regarding this matter.

 

CITY COUNCIL MINUTES, MAY 15, 1995

 

The Jonesboro City Council met Monday May 15, 1995, at 7:30 p.m. A full quorum was in attendance. Present were Mayor Brodell, City Clerk Donna Jackson, City Attorney, Phillip Crego, and all twelve Councilmen. Those Councilmen were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

The minutes of May 2, 1995, were approved as mailed on motion by Councilman Perrin seconded by Councilman Harpole. A roll call vote was taken resulting in all council members voting aye. Those Councilmen voting aye were: Vance, Wise, Rega, Evans, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Mr. Jim Stark gave a report to the Council concerning the Mosquito Control program.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO REZONE LOT 2, BLOCK B, LANES ADDITION, JONESBORO, ARKANSAS, FROM R-1 TO R-2 (Linda Smallman)

 

Councilman Vance moved, seconded by Councilman Roddy to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. Councilman Kelton requested a location map be provided to the Council by the next meeting.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (O. R. MCKISSON)

 

Councilman Harpole moved, seconded by Councilman Kelton for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The ordinance was given the number 2621.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO VACATE AND ABANDON AN UNIMPROVED PORTION OF STREET RIGHT-OF-WAY ON EAST STREET LOCATED EAST OF CHURCH STREET AND WEST OF VANDYNE. (HARVEY NEWCOM)

 

Councilman Vance moved, seconded by Councilman Perrin for the adoption of the ordinance with the stipulation that a utility easement be retained for City Water and Light. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The ordinance was given the number 2622.

 

Councilman Perrin offered the following ordinance for the first reading

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Keith Meredith)

 

Councilman Hannah moved, seconded by Councilman Kelton to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Item "E" - An ordinance to vacate a ten foot alley, located south of Washington Avenue and east of Madison Street, was tabled until June 5, 1995.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO WAIVE BIDDING OF REPAIR PARTS AND LABOR FOR A 1550 CASE DOSER.

 

Councilman Vance moved, seconded by Councilman Hannah for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The ordinance was given the number 2623.

 

Councilman Perrin offered the following ordinance for the first reading:

 

AN ORDINANCE AMENDING THE JONESBORO 1995 OPERATING BUDGET FOR THE PURPOSE OF TRANSFERRING TWO POSITIONS (CUSTODIAN AND MAINTENANCE SUPERVISOR) AND ALL APPROPRIATED FUNDS FROM THE JUSTICE COMPLEX EXPENSE TO THE POLICE DEPARTMENT BUDGET.

 

Councilman Evans moved, seconded by Councilman Perrin to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

The following bids were reviewed:

 

95:30 - Ice Control Spreader - Street Department

Councilman Vance moved, seconded by Councilman Harpole to accept the Street Committee's recommendation to accept the low bid meeting specifications of Clark Machinery for $7,714.54. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

95:31 - Sign Cutter/Plotter - Information Systems

This bid was pulled until the next meeting by the Information Systems Committee

 

95:32 - Backhoe\Loader - Street Department

Councilman Vance moved, seconded by Councilman Kelton to accept the recommendation of the Street Committee to accept the bid of Town and Country International for $52,560.00. The recommendation was made because of the better warranty and interchangeable parts. A roll call vote was taken resulting in all council members voting aye, the exception of Councilman Roddy who abstained from voting. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Harpole and Hannah.

 

95:33 - Air Compressor - Street Department

Councilman Vance moved, seconded by Councilman Harpole to accept the low bid which met specifications. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Councilman Vance moved, seconded by Councilman Harpole to reschedule the Public Hearing to vacate a ten foot alley, located south of Washington Avenue at 6:50 p.m. on June 5, 1995. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Councilman Harpole moved, seconded by Councilman Vance to set an appeal hearing for 7:10 p.m. on June 5, 1995, as requested by Mr. James Mashburn and his attorney, Charles M. Mooney, Sr. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Councilman Harpole moved, seconded by Councilman Young to adopt a resolution to condemn property on 301 Gilbert Street, owned by Ialanthe Billingsley. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:20.

 

Under new business Councilman Vance offered a resolution condemning property located at 420 Ridgecrest, owned by Willis and June Broadway, for the purpose of obtaining a drainage easement. Councilman Harpole moved, seconded by Councilman Perrin for the adoption of the resolution. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:21.

 

Councilman Roddy moved, seconded by Councilman Perrin to accept four different recommendations from the Mosquito Control Committee. The recommendations were as follows: 1) To retain Jonesboro Mosquito Control's equipment for one year, and make assess the need for equipment at that time. 2) To transfer budgeted funds between line items in the Mosquito Control Budget to cover the allotment to contract with V.D.C.I. for 1995.

3) To draft an ordinance, establishing a set procedure for the collection of Mosquito Control Revenues. 4) To allow Dr. Olsen the use of Mosquito Control's vehicle during the summer, as Jonesboro's Consultant for Mosquito Control. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah.

 

Councilman Harpole informed the Council of three different orders of business. First the Personnel Committee was provided copies of twenty-two different resumes for the position of City Engineer. Secondly, Councilman Harpole reported the Professional Services Committee had selected and prioritized the following three Project Management Firms for the 1% sales tax bonds: 1. A joint proposal from Garver & Garver and Peters & Associates. 2. Goodwin, Williams & Yates. 3. Fisher & Arnold. Mr. Harpole explained negotiations with these firms were continuing at this time. Lastly, Councilman Harpole reported to Council of improvements in the City Clerk’s Office. These improvements were a joint effort between the Personnel Committee and City Clerk, Donna Jackson. They were: 1) Providing interested individuals a choice of the Jonesboro Municipal Code. The condensed Code is now available on diskette, or in the standard hard copy form. The code book had been condensed by incorporating amended changes into the code, rather than adding pages every time an amendment was adopted. 2) Providing the Mayor, 12 Aldermen, City Attorney, and City Clerk with a customized binder to house agenda packets and committee materials. 3) Standardized committee meeting forms for the purpose of keeping other council members informed of the various committee recommendations. 4) Aldermen mail-slots for correspondence with Department Heads, Committees, Mayor and/or Citizens.

 

Councilman Hannah moved, seconded by Councilman Perrin for the adoption of a resolution to place a 25 MPH speed limit sign at Mockernut Lane. A roll call vote was taken resulting in all council members voting aye. Those Aldermen voting aye were: Vance, Wise, Rega, Evans, Province, Young, Perrin, Tate, Kelton, Roddy, Harpole and Hannah. The resolution was given the number 1995:22.

 

With no further business the meeting was adjourned.
