AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY THE ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED JULY 26, 1976, ASSIGNING SAID ANNEXED TERRITORY TO WARD 1, ZONING SAID ANNEXED TERRITORY (C-3) AND (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on May 26, 1976; and
WHEREAS, said petition for the annexation of said lands was duly signed by the sole owners of all the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing on said petition was entered, notice was duly published of said hearing, and the hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on June 28, 1976, at which hearing it was duly found and declared that said Petition for Annexation was right and proper and that such lands, hereinafter described, should be annexed to the City of Jonesboro, Arkansas; whereupon an Order of Annexation was made and entered; and
WHEREAS, thirty (30) days have expired since the Order of Annexation dated June 28, 1976, an no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its Order of August 2, 1976:
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territories and lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas, by its Order of June 28,, 1976, be, and are hereby, accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges and rights of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: That lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
All of Lots 1, 2 and 3 of Stratford Heights Addition to Jonesboro, Arkansas. (Jerry Craft)
Lots 4 thru 12 and Lots 14 thru 18 and Lot 13 of Stratford Heights Addition to the City of Jonesboro, Arkansas, also, Lot 19.
Lots 1 thru 10 of Stratford Heights First Re-plat, Jonesboro, Arkansas County, Arkansas; also a part of the Southeast Quarter of the Southeast Quarter of Section 14, Township 14 North, Range 3 East, being the South 440 feet of Lot 11 of Stratford Heights First Re-plat, Jonesboro, Craighead County, Arkansas, being more particularly described as follows: Begin at the Southwest Corner of the Southeast Quarter of the Southeast Quarter of Section 14, Township 14 North, Range 3 East; thence North 88 Degrees 18 Minutes East on the Section Line 664.8 feet; thence North 0 Degrees 06 Minutes West 41 feet to the Southwest Corner of aforesaid Lot 11, the point of beginning proper; thence North 88 Degrees 18 Minutes East 180 feet; thence North 0 Degrees 06 Minutes West 440 feet; thence South 88 Degrees 18 Minutes West 350 feet; thence South 0 Degrees 06 Minutes East 440 feet; thence North 88 Degrees 06 Minutes East 440 feet; thence North 88 Degrees 18 Minutes East 170 feet to the point of beginning proper, containing 3.53 acres, more or less.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 1 of the City of Jonesboro, Arkansas.
Section 4: That said lands hereinafter described as “All of Lots 1, 2 and 3 of Stratford Heights Addition to the City of Jonesboro, Arkansas, are hereby zoned commercial (C-3), and the remaining lands hereinabove described and annexed are hereby zoned residential (R-2).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said land and territory.
THEREFORE, an emergency is hereby declared to exist and this Ordinance, being necessary for the preservation for the public peace, health, and safety, shall take effect and be in full force and effect from and after its passage and approval.
