AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY THE ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, DATED APRIL 24, 1978, ASSIGNING SAID ANNEXED TERRITORY TO WARD 2, ZONING SAID ANNEXED TERRITORY R-3; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on March 24, 1978; and

 

WHEREAS, said petition for the annexation of said lands was duly signed by the sole owner of all the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an Order setting a hearing on said petition was entered, notice was duly published of said hearing; and the hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on April 24, 1978, at which hearing it was duly found an declared that said Petition for Annexation was right and proper and that such lands, hereinafter described, should be annexed to the City of Jonesboro, Arkansas, whereupon, an Order of Annexation was made and entered.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro. Arkansas:

 

Section 1: The territories and lands annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas, by its Order of April 24, 1978, be, and are hereby, accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the privileges and rights of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: That lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

                     

Part of the Northeast Quarter of Section 7, Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows: Commencing at the Southwest corner of said Northeast Quarter of Section 7; thence North 88 Degrees 44 Minutes East along the center of said Section 7 a distance of 1537.0 feet to the point of beginning proper; thence North 0 Degree 32 Minutes West 417.42 feet; thence South 88 Degrees 44 Minutes West 11.2 feet; thence North 1 Degree 16 Minutes West 260.0 feet; thence South 88 Degrees 44 Minutes West 1025.7 feet; thence North 0 Degree 29 Minutes West 626.9 feet to an existing fence corner; thence North 88 Degrees 37 Minutes East 1200.0 feet; thence South 0 Degree 32 Minutes East 1306.7 feet; thence South 88 Degrees 44 Minutes West 160.7 feet to the point of beginning proper, containing 19.87 acres, more or less.

 

Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 2 of the City of Jonesboro, Arkansas.

 

Section 4: That said lands hereinabove described are hereby zoned residential (R-3).

 

Section 5: It is hereby found and declared by the City Council of the City, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said land and territory; that city utilities also are to hereafter be extended to said property and citizens and property owners of said property.

 

THEREFORE, an emergency is hereby declared to exist and this Ordinance, being necessary for the preservation of the public peace, health, safety and welfare, shall take effects and be in full force and effect from and after its passage and approval.
