AN ORDINANCE ABANDONING AN UNDEVELOPED STREET PLATTED AS AZALEA COVE LOCATED IN BLOCK B OF AGGIE VILLAGE, A PORTION OF A CUL-DE-SAC ON AZALEA LANE LOCATED IN BLOCK A OF AGGIE VILLAGE, AND A PORTION OF AZALEA LANE LOCATED IN AGGIE VILLAGE TO THE CITY OF JONESBORO, ARKANSAS.

WHEREAS, the City Council at its regular meeting on April 7, 1997, heard the request of Mike Cameron to abandon Azalea Cove located in Block B of Aggie Village and a portion of a cul-de-sac on Azalea Lane located in Block A of Aggie Village, and a portion of Aggie Lane which is located in Aggie Village; and
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, the best interest of the owner of said property will be served by the closing and abandoning of said undeveloped street, a portion of the cul-de-sac described above, and a portion of Azalea Lane; and
WHEREAS, Mike Cameron has received approval from all utility companies for said abandonment; and
WHEREAS, the abandonment of said streets and portion of the cul-de-sac would not adversely affect any utility companies and would be in the best interest of all parties concerned.
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights together with the right of the public generally, in and to the undeveloped street platted as Azalea Cove, a portion of a cul-de-sac on Azalea Lane West of the West right of way as platted in Lot 2, Block A of Aggie Village to the City of Jonesboro, and a portion of Azalea Lane described as : That portion of the right of way for Azalea Lane which lies West of the Southerly extension of the East line of Lot 1, Block "A" together with that portion of the right of way for Azalea Lane which lies South of the Westerly extension of the North line of Lot 1, Block "B", together with the right of way for Azalea Cove, according to the plat of Aggie Village, City of Jonesboro, Craighead County, Arkansas, containing in all 29,037 square feet or 0.667 acres, more or less, subject to easements, restrictions, reservations and rights of way of record, together with the utility easements which are adjacent to the above described road rights of way.
SECTION 2: A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed Records of Craighead County, Arkansas.
SECTION 3: The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described streets and portion of the cul-de-sac is in the public interest and will promote the public peace and welfare. And further, the City Council finds that an emergency exists and this ordinance being necessary for the protection and promotion of the public health, welfare and safety, the same shall take effect from and after its passage and approval.
