AN ORDINANCE ABANDONING A PORTION OF UTILITY EASEMENT BETWEEN CLARK'S AND HEDGER'S SUBDIVISION LOCATED IN THE CITY OF JONESBORO, ARKANSAS AS REQUESTED BY RUBEN GRIFFIN

WHEREAS, the City Council of the City of Jonesboro, Arkansas, at its regular meeting, hearing the request to abandon a portion of utility easement between Clark's and Hedger's Subdivision described as follows:
That part of Tract C-2 from the Re-plat of Tract C of Clark's First Subdivision and Lot 5 of Hedger's Subdivision First Addition both being a part of the North Half of the Southeast Quarter of Section 33, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Beginning at the Northeast corner of Lot 5 of Hedger's Subdivision, run thence, S0°23'W 10 feet, runt thence S88°18' W 209.6 feet, run thence N0°23'E 10 feet , run thence S 88°18'W 104.0 feet, run thence N1°50'W 7.5 feet, run thence N88°18'E 313.6 feet, run thence S 1° 42' E. 7.5 feet, containing 0.10 acres, more or less.
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, the abandonment of the aforementioned Rights-of-Way would not affect the use of and would be in the best interest of all parties concerned;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
SECTION 1: The City of Jonesboro, Arkansas, hereby vacates and abandons all of its rights, together with the right of the public generally, in Jonesboro, Arkansas.
SECTION 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of Craighead County, as Jonesboro, Arkansas and recorded in the Deed Records of Craighead County, Arkansas.
SECTION 3: The closing, vacating, and abandonment by the City of its rights and the rights of the public generally in the above described portion of the easements is in the public interest and will promote the public peace and welfare. And further, the City Council finds that an emergency exists and the ordinance being necessary for the protection and promotion of the public health, welfare, and safety, the same shall take effect from and after its passage and approval.
