AN ORDINANCE TO PROVIDE WEIGHT LIMITATIONS ON CERTAIN CITY STREETS: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF; AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The City Council finds and declares that certain weight limitations should be imposed on the following streets in Jonesboro, Arkansas, in order to maintain the streets and to prevent the erosion of said streets, and that certain signs will need to be displayed on streets to inform the public of the weight limitations as imposed on the following streets:

 

(a) A 20 ton gross weight limit on Woodrow & Forrest Streets from Main to Culberhouse

(b) A 20 ton gross weight limit on all of Wood Street

(c) A 20 ton gross weight limit on Church Street from Forrest to Word

 

Section 2: The drivers of all vehicles shall obey all load limit signs per instruction on the face thereof.

 

Section 3: The Chief of Police or some person designated by him is hereby directed to place and locate upon the above described streets at the proper locations; appropriate signs designating the load limits set out above, and it shall be unlawful for any person, firm, or corporation to tear down, remove, or mutilate said signs.

 

Section 4: Every person convicted of a violation of any provision of this Ordinance shall be punished by a fine of not more than one hundred ($100.00) and in addition shall be fined one dollar ($1.00) per pound for each pound said vehicle is in excess of the gross limit as established by this Ordinance.

 

Section 5: All ordinances and/or parts of ordinances in conflict herewith are hereby repealed.

 

Section 6: It is found and declared by the City Council that the maintenance of streets and the erosion of streets are caused by vehicles of excessive weight traveling upon said streets and that this ordinance shall limit the erosion and minimize the maintenance of these streets as set out above, and that this Ordinance being necessary for the preservation of the public peace, health, and safety, an emergency is hereby declared to exist and this Ordinance shall take effects from and after its passage and approval.
