AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT DATED MARCH 23, 1977; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, DELARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on February 17, 1977, and
WHEREAS, said petition for the annexation of said land was signed by all the real estate owners owning all of the acreage to be annexed to the City of Jonesboro, and
WHEREAS, an ordinance setting down a hearing upon said petition was entered, notice was duly published of said hearings, and the hearing upon said petition was duly had and held in the County Court on March 22, 1977, at which hearing it was duly found and declared that said petition for annexation was right and to the City of Jonesboro, whereupon an order of annexation was made and entered and
WHEREAS, 30 days have expired since the order of annexation dated March 23, 1977, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas and said annexation proceedings were and all things confirmed by the County Court by its order of April 27, 1977.
NOW THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, by its order of March 23, 1977, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and the residents residing therein shall have and enjoy all of the rights and privileges of inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
Part of the North half of the Southeast Quarter of Section 23, Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the Northeast Corner of the Southeast Quarter of Section 23, aforesaid: thence South 89 degrees 40’ West along the North line of the Southeast Quarter a distance of 590.0 feet; thence South 280 degrees 24’ West 535.5 feet; thence South 22 degrees 28’ West 129.2 feet; thence South 21 degrees 22’ West 39.1 feet to the center of Tanglewood Drive and the point of beginning proper; thence continue South 21 degrees 22’ West 138.9 feet; thence South 89 degrees 40’ West 529.9 feet; thence South 3 degrees 35’ West 193.4 feet; thence North 84 degrees 53’ West 199.6 feet; thence North 3 degrees 35’ East 9.85 feet; thence North 80 degrees 14’ West 232.05 feet; thence North 72 degrees 40’ West 85.2 feet; thence South 74 degrees 02’ West 159.0 feet; thence North 15 degrees 58’ West 175.0 feet; thence South 74 degrees 02’ West 95.34 feet; thence Southwesterly along a curve to the left having a radius of 104.13 feet, a distance of 59.4 feet; thence North 48 degrees 39’ West 90.0 feet; thence North 65 degrees 29, West 153.9 feet; thence North 0 degrees 39’ East 219.7 feet; thence North 88 degrees 12’ East 564.8 feet; thence North 3 degrees 07’ West 14.9 feet; thence North 89 degrees 26’ East 579.3 feet; thence South 3 degrees 35’ West 224.8 feet; thence North 89 degrees 40’ East 316.9 feet; thence South 79 degrees 13’ East 43.0 feet; thence North 89 degrees 40’ East 247.0 feet to the point of beginning proper and containing 12.98 acres, more or less; the same also described as Briarwood 6th Addition as shown be recorded Plat in Deed Record 198 at page 84.
Section 3: The lands and territory annexed to the City of Jonesboro, Arkansas, are hereby accepted by the City of Jonesboro, and hereby assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.
Section 4: Said lands are to be zoned R-2.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme emergency that the territory herein be immediately annexed to and accepted by the City of Jonesboro and that it is in the interest of the City of Jonesboro that the citizens and property of said territory set out above be entitled to fire, police, zoning and other protection and benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this Ordinance is necessary for the preservation of the public peace, health and safety.
PASSED and ADOPTED this 3rd day of October, 1977.
