ORDINANCE TO VACATE AND ABANDON A PORTION OF OLD STATE HIGHWAY 39 WITHIN THE CITY LIMITS OF THE CITY OF JONESBORO, ARKANSAS

WHEREAS, a Petition was duly filed with the City Council of the City of Jonesboro, Arkansas on 7th day of November, 1966, praying the City Council to vacate and abandon that portion of a city street described as follows:
Begin at the Southwest Corner of Southeast Quarter of Southwest Quarter of Section 19, Township 14 North, Range 4 East, thence North on the West line of Southeast Quarter of Southwest Quarter 30 feet to the North right-of-way line of Highland Drive; thence East on the aforesaid North line and parallel to the section line 715.15 feet to the Southwest corner of Block A of Tom Lane Addition to Jonesboro, Arkansas the point of beginning proper, thence Northeasterly along the West line of aforesaid Block A and the South and East right-of-way of Old Highway No.39 on a 9° 21' curve to the left 396.5 feet to the North corner of Block A of Tom Lane Addition; thence Northwesterly on a curve (radius 36') to the left 56.55 feet; thence West on the North line of Block B of Tom Lane Addition produced East a distance of 1.0 feet to the North and West right-of-way line of Old Highway No.39; thence Southwesterly along aforesaid right-of-way line on a 10" 11' curve to the right 399.7 feet; thence Southeasterly on a curve to the left (radius of 46.4') a distance of 55.64 feet to the point of beginning proper.
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question, and has ascertained that the street, hereinabove described, has heretofore been used by the general public as a street; that following the abandonment of Old Highway 39 by the State Highway Department, that portion thereof within the City limits became a part of the city street system of Jonesboro; that that portion of Old Highway 39 within the City Street system has been extended and named Highland Drive so as to intersect with Main Street at right angles; that all the owners of property abutting upon that portion of the street to be vacated as described above have filed with the City Council their written consent to such abandonment; that the public interest and welfare will not be adversely affected by the abandonment of such street; that authority is vested in the City Council to vacate and abandon the above described portion of said street in accordance with Section 19-3813, Arkansas Stats.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to that portion of Old State Highway No.39 within the City limits of Jonesboro more particularly described as follows:
Begin at the Southwest Corner of Southeast Quarter of Southwest Quarter of Section 19, Township 14 North, Range 4 East, thence North on the West line of Southeast Quarter of Southwest Quarter 30 feet to the North right-of-way line of Highland Drive; thence East on the aforesaid North line and parallel to the Section line 715.15 feet to the Southwest corner of Block A of Tom Lane Addition to Jonesboro, Arkansas, the point of beginning proper; thence Northeasterly along the West line of aforesaid Block A and the South and East right-of-way line of Old Highway No.39 on a 9° 21' curve to the left 396.5 to the North corner of Block A of Tom Lane Addition to Jonesboro thence Northwesterly on a curve (radius 36') to the left 56.55 feet; thence West on the North line of Block B of Tom Lane Addition produced East a distance of 1.0 feet to the North and West right-of-way line of Old Highway No.39; thence Southwesterly along aforesaid right-of-way line on a 10° 11' curve to the right 399.7 feet; thence Southeasterly on a curve to the left (radius of 46.4') a distance of 55.64 feet to the point of beginning proper.
Section 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County, and recorded in the Deed Records of said County.
Section 3: This ordinance shall take effect and be in force from and after its passage.
