AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on March 19, 1981, and
WHEREAS, an Order setting a hearing upon said Petition was entered, notice was duly published of said hearing and a hearing upon said Petition was held in the County Court of Craighead, County, Arkansas on March 24, 1981, at which hearing it was duly found and declared that said Petition for annexation was right and proper and that these lands hereinafter should be annexed to the City of Jonesboro, Arkansas whereupon an Order of annexation was made and entered; and
WHEREAS, thirty days have expires since the Order of annexation dated March 24, 1981, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas; and
WHEREAS, the Metropolitan Area Planning Commission has made its recommendation to the City Council of the City of Jonesboro, that this property be annexed into the city with the zoning classification (R-2).
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territories and land annexed to the City of Jonesboro by Order of the County Court of Craighead County, Arkansas, by its Order of March 24, 1981, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more particularly described as follows:
TACT 1: Beginning survey at the center of Section 29, thence North 89 degrees 02’ East 220.0 feet to a point in the centerline of Race Street; thence North 00 degrees 12’ East 50.0 feet to the point of beginning proper; thence continue North 00 degrees 12’ East 110.0 feet to a point thence South 89° 02’ West 170.0 feet to a point; thence South 00° 12’ West 110.0 feet to a point; thence North 89° 02’ East 170.0 feet to the point of beginning, containing 0.429 acres more or less.
TRACT 2: Begin survey at the center of Section 29; thence North 89° 02 East 220.0 feet to a point in the centerline of Race Street; thence North 00° 12’ East 160.0 feet to the point of beginning proper; thence continue North 00° 12’ East 114.0 feet to a point; thence South 89° 02’ West 170.0 feet to a point; thence South 00° 12’ West 114.0 feet to a point; thence North 89° 02’ East 170.0 feet to the point of beginning, containing 0.445 acres more or less.
TRACT 3: Beginning survey at the center of Section 29; thence North 89°02’ East 220.0 feet to a point in the centerline of Race Street, thence north 00°12’ East 274.0 feet to the point of beginning proper; thence continuing North 00° 12’Est 114.05 feet to a point; thence South 89°00’ West 170.0 feet to a point; thence South 00°12’ West 114.25 Feet to a point; thence north 89°02’ East 170.0 feet to the point of beginning, containing 0.446 acres more or less.
TRACT 4: Beginning at the Northwest corner of Southwest quarter of the Northeast quarter of Section 29, Township 14, North, Range 4 East, thence East 210.0 feet; thence South 207.0 feet; thence West 210.0 feet thence North 207.0 feet to the point of beginning.
Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to Ward 5 to the City of Jonesboro, Arkansas.
Section 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Residential (R-2).
Section 5: It is found and declared by the City Council of the City of Jonesboro, Arkansas that there is now a extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property owners and the citizens of this territory can be entitled to fire, police , zoning, water and sewage and other protection and benefits; that these benefits and protection are urgently needed in order to allow orderly growth and development of said lands and territories. Therefore, an emergency is hereby declared to exist and this ordinance is necessary for the preservation of the public peace, health and safety and welfare and shall take effect and be in full force from and after its passage and approval.
